Abstract
The development of digital technology has given rise to platforms such as TikTok and YouTube Shorts as media for expression through short videos and has created the profession of content creator. However, this development has also given rise to copyright infringement issues, particularly the practice of unauthorized reuploading, which harms creators both morally and economically. This study aims to analyze the legal protection for TikTok video content creators whose work is reuploaded to YouTube Shorts, as well as the legal liability of reuploaders and YouTube based on Law Number 28 of 2014 concerning Copyright. This study uses legal protection theory and legal liability theory with a normative juridical method, through a legislative and non-judicial case study approach, supported by interviews with relevant parties. The data used consists of primary and secondary data obtained through field studies and literature studies, which were then analyzed qualitatively. The results of the study show that legal protection for content creators has been normatively regulated in Law Number 28 of 2014 concerning Copyright, but its implementation has not been optimal. This is due to the low awareness of content creators to report copyright violations of their work, as done by Naila, and based on the results of interviews with the DJKI. The lack of reports has led to the continued practice of unauthorized reposting, resulting in the loss of creators economic and moral rights. Perpetrators are subject to sanctions, both in terms of compensation and criminal penalties, based on Articles 112 113 of Law Number 28 of 2014. Meanwhile, YouTube as a platform has a moral and legal responsibility to enforce copyright protection by removing infringing content, blocking the accounts of users who commit violations, and improving the copyright system on its platform, as stipulated in Articles 55 Article 5, Paragraphs 3 and 4 of the Copyright Law. Therefore, cooperation between content creators and digital platforms is needed to take firm action against repeat uploaders. | Additional Information: | Perkembangan teknologi digital melahirkan platform TikTok dan YouTube Shorts sebagai media ekspresi melalui video pendek serta menciptakan profesi pembuat konten (content creator). Namun, perkembangan ini juga memunculkan permasalahan pelanggaran hak cipta, khususnya praktik pengunggahan ulang (reupload) tanpa izin yang merugikan pencipta baik secara moral maupun ekonomi. Penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pembuat konten video TikTok yang karyanya diunggah ulang ke YouTube Shorts, serta bentuk tanggung jawab hukum pelaku pengunggah ulang dan pihak YouTube berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Penelitian ini menggunakan teori perlindungan hukum dan teori tanggung jawab hukum dengan metode yuridis normatif, melalui pendekatan perundang-undangan dan non judicial case study, serta didukung wawancara dengan pihak terkait. Data yang digunakan terdiri dari data primer dan data sekunder yang diperoleh melalui studi lapangan dan studi kepustakaan, kemudian dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap pembuat konten telah diatur secara normatif dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, namun implementasinya belum optimal. Hal ini salah satunya disebabkan oleh rendahnya kesadaran pembuat konten untuk melaporkan pelanggaran hak cipta atas karya mereka, seperti yang dilakukan oleh Naila, dan berdasarkan hasil wawancara dengan DJKI. Minimnya laporan, menyebabkan praktik pengunggahan ulang tanpa izin terus terjadi dan berdampak pada kerugian hak ekonomi dan hak moral pencipta. Dan untuk pertanggungjawaban, Pelaku dapat dikenai sanksi, baik dari segi ganti rugi, maupun pidana, berdasarkan Undang-Undang Nomor 28 Tahun 2014 Pasal 112-113. Sedangkan YouTube sebagai platform memiliki tanggung jawab moral dan hukum untuk menegakkan perlindungan hak cipta melalui penghapusan konten pelanggar, pemblokiran akun pengguna yang melakukan pelanggaran, serta peningkatan sistem hak cipta pada platformnya, sebagaimana diatur dalam Pasal 55 ayat 3, dan 4 Undang-Undang Hak Cipta. Demikian, diperlukan kerjasama antar pembuat konten, dan platform digital untuk menindak tegas pelaku pengunggahan ulang yang sering terjadi.
