Abstract
The Education and Culture Office of South Tangerang City is responsible for the management and preservation of cultural heritage that functions as a tourist destination, in accordance with the provisions stipulated in the Regional Regulation of South Tangerang City Number 3 of 2022 concerning the Management and Preservation of Cultural Heritage. This study aims to identify the implementation of local government authority and the obstacles it faces in the process. The identification of problems in this study leads to two main aspects: first, the authority of the local government related to the management and preservation of cultural heritage; second, the obstacles that arise in the implementation of this authority. The theories used in this study include the theory of authority and the theory of tourism management. The theory of authority clarifies the rights and responsibilities of local governments in the regulation and preservation of cultural heritage, while the theory of tourism management provides a framework for understanding how cultural heritage can be managed as a sustainable tourist attraction. The method applied in this study is the empirical legal method, which integrates secondary data analysis from relevant legal and regulatory literature, as well as primary data obtained through interviews with related parties at the Education and Culture Office of South Tangerang City. Although there are efforts such as digital promotion and educational activities to increase public awareness of the importance of cultural heritage management, the challenges faced include: First, the lack of trained human resources in the field of cultural heritage management. Second, minimal budget allocation for cultural heritage preservation activities. Third, the lack of effective cooperation between government agencies, which results in low levels of coordination and alignment in decision making. The conclusion of this study shows that local governments have quite strong authority in the management and preservation of cultural heritage, they are faced with various obstacles. Therefore, it is recommended that there be increased cooperation between the government, the community, and other stakeholders, as well as an increase in budget allocation for cultural heritage preservation activities. With these steps, it is hoped that the management of cultural heritage in South Tangerang City can run more effectively and provide greater benefits to the community.

Penelitian ini bertujuan untuk mengidentifikasi pelaksanaan kewenangan pemerintah daerah serta kendala yang dihadapinya dalam proses tersebut. Identifikasi permasalahan dalam penelitian ini mengarah pada dua aspek utama: pertama, kewenangan pemerintah daerah terkait dengan pengelolaan dan pelestarian cagar budaya; kedua, kendala yang muncul dalam implementasi kewenangan tersebut. Teori yang digunakan dalam penelitian ini mencakup teori kewenangan dan teori pengelolaan pariwisata. Teori kewenangan memperjelas hak dan tanggung jawab pemerintah daerah dalam pengaturan dan pelestarian cagar budaya, sedangkan teori pengelolaan pariwisata memberikan kerangka kerja untuk memahami bagaimana cagar budaya dapat dikelola sebagai daya tarik wisata yang berkelanjutan. Metode yang diterapkan dalam penelitian ini adalah metode yuridis empiris, yang mengintegrasikan analisis data sekunder dari literatur hukum dan peraturan yang relevan, serta data primer yang diperoleh melalui wawancara dengan pihak-pihak terkait di Dinas Pendidikan dan Kebudayaan Kota Tangerang Selatan. Meskipun terdapat upaya seperti promosi digital dan kegiatan edukatif untuk meningkatkan kesadaran masyarakat akan pentingnya pengelolaan cagar budaya, tantangan-tantangan yang dihadapi meliputi: Pertama kekurangan sumber daya manusia yang terlatih dalam bidang pengelolaan cagar budaya. Kedua alokasi anggaran yang minim untuk kegiatan pelestarian cagar budaya. Ketiga kurangnya kerjasama yang efektif antar lembaga pemerintah, yang menyebabkan rendahnya tingkat koordinasi dan keselarasan dalam pengambilan keputusan. Kesimpulan dari penelitian ini menunjukkan pemerintah daerah memiliki kewenangan yang cukup kuat dalam pengelolaan dan pelestarian cagar budaya, mereka dihadapkan pada berbagai kendala. Oleh karena itu, disarankan agar terdapat peningkatan kerjasama antara pemerintah, masyarakat, dan pemangku kepentingan lainnya, serta adanya peningkatan alokasi anggaran untuk kegiatan pelestarian cagar budaya. Dengan langkah-langkah tersebut, diharapkan pengelolaan cagar budaya di Kota Tangerang Selatan dapat berjalan lebih efektif dan memberikan manfaat yang lebih besar bagi masyarakat. | |||||||||
