Abstract

The right to employment is one of the fundamental human rights that also applies to persons with disabilities. The City of Serang, located in Banten Province, has policies regarding the fulfillment of disability rights as regulated in Regional Regulation Number 13 of 2019 concerning the Protection of Persons with Disabilities, which is further implemented through Mayor Regulation Number 101 of 2021. However, in practice, the fulfillment of employment rights for persons with disabilities in Serang City has not been fully achieved. This study aims to identify and analyze the implementation of the fulfillment of employment rights for persons with disabilities in Serang City using Søren C. Winter’s policy implementation model and a descriptive qualitative method, with eight informant. The results show that the implementation has not been optimal. The commitment of local agencies, such as the BKPSDM, which has allocated a 2% quota for persons with disabilities in civil service recruitment since 2021, has not been followed by strong local initiatives and still depends on central government directives. Coordination among the Social Service, the Manpower and Transmigration Office, and the BKPSDM is also suboptimal, as no inter-agency forum has been established. At the implementer level, monitoring remains limited, and accessibility facilities are inadequate due to budget constraints. Meanwhile, the target group shows enthusiasm for the programs but considers their implementation ineffective and the socialization insufficient. Overall, the implementation of this policy has not been optimal, particularly in terms of coordination, supervision, and the participation of persons with disabilities.

Additional Information: Hak ketenagakerjaan merupakan salah satu hak yang asasi manusia yang juga berlaku bagi penyandang disabilitas, Kota Serang merupakan salah satu kota di Provinsi Banten yang memiliki kebijakan mengenai pemenuhan hak-hak disabilitas yang diatur dalam Peraturan Daerah Kota Serang Nomor 13 Tahun 2019 tentang Pelindungan Penyandang Disabilitas yang secara khusus pelaksanaannya diatur dalam Peraturan Walikota Serang Nomor 101 Tahun 2021 tentang Pelaksanaan Peraturan Daerah Nomor 13 Tahun 2019 Tentang Penyandang Disabilitas. Namun, dalam implementasinya ditemukan permasalahan bahwa hak ketenagakerjaan bagi penyandang disabilitas di Kota Serang belum terpenuhi secara optimal. Penelitian ini bertujuan untuk mengetahui dan menganalisis implementasi pemenuhan hak ketengakerjaan penyandang disabilitas di Kota Serang menggunakan model implementasi kebijakan Soren C. Winter dan menggunakan metode penelitian kualitatif deskriptif, dengan delapan Informan. Hasil penelitian menunjukkan bahwa implementasi pemenuhan hak ketenagakerjaan penyandang disabilitas di Kota Serang belum optimal. Hasilnya menunjukkan bahwa komitmen OPD, seperti BKPSDM yang menyediakan kuota 2% ASN disabilitas sejak 2021, belum diikuti dengan inisiatif lokal yang kuat dan masih bergantung pada arahan pusat. Koordinasi antar Dinas Sosial, Disnakertrans, dan BKPSDM juga belum optimal karena belum ada forum lintas dinas. Pada tingkat implementor, pengawasan masih terbatas dan fasilitas aksesibilitas belum memadai akibat keterbatasan anggaran. Sementara itu, kelompok sasaran menunjukkan antusiasme terhadap program, namun menilai pelaksanaannya kurang efektif dan sosialisasi masih minim. Secara keseluruhan, implementasi kebijakan ini belum berjalan optimal, terutama dalam aspek koordinasi, pengawasan, dan partisipasi penyandang disabilitas.
