Abstract
The execution of substitute money by Public Prosecutors plays a strategic role in recovering state financial losses resulting from corruption crimes, as well as contributing to Non-Tax State Revenue (PNBP). However, in practice, this execution faces several challenges, including limited human resources, weak inter-agency coordination, and inadequate technical expertise in asset tracing. This study aims to analyze the authority of Public Prosecutors in the execution of substitute money based on Law Number 11 of 2021 concerning the Attorney General’s Office of the Republic of Indonesia and to evaluate the effectiveness of asset tracing mechanisms in implementing such executions.This research uses a normative juridical method with a regulatory approach, case studies at the Serang District Prosecutor’s Office, and interviews with prosecutors involved in the execution process. The findings indicate that the prosecutors’ authority to execute substitute money has been regulated comprehensively, but its implementation still encounters practical obstacles. These include the transfer of assets to third parties, lack of asset data, and resistance from convicts. On the other hand, significant successes have been achieved through coordination with the National Land Agency (BPN), the Financial Transaction Reports and Analysis Center (PPATK), and other related institutions. The novelty of this study lies in its integrative analysis of prosecutorial authority and the effectiveness of asset tracing as a strategy for recovering state losses, emphasizing the principles of legal certainty, effectiveness, and public accountability. This study proposes: (1) strengthening the institutional capacity of the Attorney General’s Office through technical training and adequate budget allocation; (2) developing an integrated inter-agency asset database to facilitate asset tracing and confiscation; (3) formulating more detailed technical guidelines for the execution of substitute money; and (4) enhancing international cooperation for cross-border asset tracing. These steps are expected to optimize the execution of substitute money in supporting the recovery of state finances.

Additional Information: | Eksekusi uang pengganti oleh Jaksa Penuntut Umum memiliki peran strategis dalam upaya pemulihan kerugian negara akibat tindak pidana korupsi, sekaligus sebagai bagian dari Penerimaan Negara Bukan Pajak (PNBP). Namun, dalam praktiknya, pelaksanaan eksekusi sering menghadapi kendala seperti keterbatasan sumber daya manusia, lemahnya koordinasi lintas instansi, dan minimnya pemahaman teknis terkait penelusuran aset. Penelitian ini bertujuan untuk menganalisis kewenangan Jaksa Penuntut Umum dalam eksekusi uang pengganti berdasarkan Undang-Undang Nomor 11 Tahun 2021 tentang Kejaksaan Republik Indonesia, serta mengevaluasi efektivitas mekanisme penelusuran aset dalam rangka pelaksanaan eksekusi. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, studi kasus di Kejaksaan Negeri Serang, dan wawancara dengan jaksa yang terlibat dalam proses eksekusi. Data yang diperoleh menunjukkan bahwa kewenangan jaksa dalam eksekusi uang pengganti telah diatur secara komprehensif, namun implementasinya masih terkendala di lapangan. Hambatan meliputi peralihan aset kepada pihak ketiga, keterbatasan data aset, dan resistensi terpidana. Di sisi lain, terdapat pula keberhasilan signifikan melalui koordinasi dengan Badan Pertanahan Nasional (BPN), Pusat Pelaporan dan Analisis Transaksi Keuangan (PPATK), dan instansi terkait lainnya. Novelty dari penelitian ini terletak pada analisis integratif kewenangan jaksa dan efektivitas penelusuran aset sebagai strategi pemulihan kerugian negara, dengan menekankan prinsip kepastian hukum, efektivitas, dan akuntabilitas publik. Studi ini mengusulkan: (1) penguatan kapasitas kelembagaan Kejaksaan melalui pelatihan teknis dan alokasi anggaran memadai; (2) pembangunan sistem data aset terintegrasi antarinstansi untuk mempermudah penelusuran dan penyitaan aset; (3) penyusunan pedoman teknis eksekusi uang pengganti yang lebih rinci; serta (4) peningkatan kerja sama internasional untuk pelacakan aset lintas negara. Dengan langkah-langkah tersebut, diharapkan eksekusi uang pengganti dapat berjalan lebih optimal dalam mendukung pemulihan keuangan negara. | |||||||||
