Abstract
This research is based on the many complaints from the public regarding the fulfillment of consumer rights which have not been implemented in the practice of buying and selling petrol through Pertamini or retail petrol sellers. Many cases have become the subject of discussion where the fuel oil (BBM) rate between Pertamini and the rate at the station Public Fuel Filling (SPBU) is very different and consumers feel disadvantaged. The identification of the problem in this research is how legal protection is for consumers against the sale of gasoline by Pertamini which is not properly measured in Pandeglang Regency based on Law Number 8 of 1999 concerning Consumer Protection and what is the responsibility of business actors regarding the sale of gasoline by Pertamini which is not the exact dose in Pandeglang Regency. The theory used in this research is the theory of legal protection. The method used in this research is a qualitative research method with a normative juridical research type. The results of this research are that there are 2 (two) forms of legal protection for consumers for fuel oil losses at Pertamini, namely preventive legal protection and repressive legal protection. Preventive protection is a form of preventing the occurrence of a problem by carrying out test and re-test activities on engine system to maintain the accuracy of the fuel dosage received by consumers. Repressive protection is legal protection which is more indicated in resolving disputes by taking action, if business actors have been proven to have committed fraud, the Legal Metrology Standardization Agency and Dispindag collaborate with other legal authorities to carry out the action of sealing business premises to provide a deterrent effect to business actors and provide compensation to consumers when consumers feel aggrieved. The form of responsibility of business actors is in the form of product liability in which Pertamini business actors have the responsibility to provide guarantees for consumer rights, especially the right to comfort, the right to correct, clear and honest information, as well as the right to receive compensation for losses.

| Additional Information: | Penelitian ini dilatar belakangi banyaknya keluhan masyarakat terkait pemenuhan hak-hak konsumen yang belum terlaksana dalam praktik jual beli bensin melalui pertamini atau penjual bensin eceran, banyak kasus yang sudah menjadi bahan perbincangan yang mana takaran Bahan Bakar Minyak (BBM) antara pertamini dengan takaran di Stasiun Pengisian Bahan Bakar Umum (SPBU) sangat jauh berbeda dan konsumen merasa dirugikan. Identifikasi masalah dalam penelitian ini adalah bagaimana perlindungan hukum bagi konsumen terhadap penjualan bahan bakar bensin oleh pertamini yang tidak tepat takarannya di Kabupaten Pandeglang berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen dan bagaimana tanggungjawab pelaku usaha terhadap penjualan bahan bakar bensin oleh pertamini yang tidak tepat takarannya di Kabupaten Pandeglang . Teori digunakan dalam penelitian ini yaitu teori perlindungan hukum. Metode yang digunakan dalam penelitian ini adalah metode penelitian kualitatif dengan jenis penelitian yuridis normatif. Hasil penelitian ini Bahwasannya Bentuk Perlindungan Hukum bagi Konsumen atas kerugian pengisian Bahan Bakar Minyak di Pertamini ada 2 (dua) bentuk yaitu perlindungan hukum preventif dan perlindungan hukum represif, perlindungan preventif merupakan suatu bentuk pencegahan terjadinya suatu masalah dengan dilakukannya kegiatan uji tera dan tera ulang terhadap system mesin demi menjaga keakuratan takaran bahan bakar yang diterima konsumen. Perlindungan secara Refresif merupakan perlindungan hukum dimana lebih ditunjukkan dalam menyelesaikan sengketa dilakukan dengan penindakan, apabila pelaku usaha telah terbukti melakukan kecurangan maka Badan Standarisasi Metrologi Legal maupun Disprindag bekerjasama dengan aparat hukum lainnya untuk melakukan tindakan penyegelan tempat usaha untuk memberikan efek jera kepada pelaku usaha dan memberikan ganti rugi kepada konsumen ketika konsumen merasa dirugikan. Bentuk tanggung jawab pelaku usaha dalam bentuk product liability yang mana pelaku usaha pertamini memiliki tanggung jawab untuk memberikan jaminan terhadap hak-hak konsumen, khususnya terhadap hak atas kenyamanan, hak atas informasi yang benar, jelas, dan jujur, serta hak untuk mendapatkan ganti kerugian. | |||||||||
