Abstract
The Serang City Government through Mayor Regulation Number 88 of 2021 concerning Civil Servant Discipline provides massive regulations. However, in reality, there are still many who violate it, so there must be strict enforcement in resolving this problem. Then, periodic evaluation is needed to find out what are the obstacles to enforcing this discipline. The identification of the problem in this study is how the implementation of disciplinary enforcement for Civil Servants is against violations of working hours in the Serang City Government based on Mayor Regulation Number 88 of 2021 concerning Enforcement of Civil Servant Discipline and what are the obstacles to the implementation of disciplinary enforcement for Civil Servants against violations of working hours in the Serang City Government based on Mayor Regulation Number 88 of 2021 concerning Enforcement of Civil Servants Discipline. The purpose of this study is to determine the efforts to enforce discipline and obstacles to enforcing discipline for civil servants in the Serang City government. The theories used are the Theory of Authority and the Theory of Enforcement of State Administrative Law. The method used is empirical juridical. The research specifications used are descriptive qualitative analysis research types. The data sources used are secondary data sources which are divided into parts, namely primary legal materials, secondary legal materials, and tertiary legal materials, with data collection techniques of library studies and field studies. The results of the study were based on the Serang Mayor Regulation Number 88 of 2021 concerning the Enforcement of Civil Servant Discipline that in terms of enforcing civil servant discipline in Serang City, it is the authority of each relevant agency leader. In line with the theory of authority which explains that authority is the right to govern, make decisions, and determine policies. The authority itself can be obtained through Attribution, Delegation, and Mandate. Furthermore, obstacles in the implementation of civil servant discipline enforcement in Serang City are due to the lack of civil servant self-awareness regarding discipline, then due to the mismatch of their expectations regarding their duties and job placement, and many civil servants have debts. Administrative law enforcement against civil servants who are often late for work, starting from delays in promotions and positions to dishonorable dismissal.

Additional Information: | Pemerintahan Kota Serang melalui Peraturan Wali Kota Nomor 88 Tahun 2021 Tentang Disiplin PNS memberikan aturan yang masif. Namun dalam kenyataannya masih saja banyak yang melanggar, maka harus adanya penegakan yang tegas dalam menyelesaikan masalah ini. Kemudian perlu evaluasi secara berkala untuk mengetahui apa saja yang menjadi hambatan penegakan kedisiplinan tersebut. Identifikasi masalah pada penelitian ini adalah bagaimana pelaksanaan penegakan disiplin bagi PNS terhadap pelanggaran jam kerja di Pemerintah Kota Serang berdasarkan Peraturan Walikota Nomor 88 Tahun 2021 Tentang Penegakan Disiplin PNS serta apa hambatan pelaksanaan penegakan disiplin PNS terhadap pelanggaran jam kerja di Pemerintah Kota Serang berdasarkan Peraturan Walikota Serang Nomor 88 Tahun 2021 Tentang Penegakan Disiplin PNS. Tujuan Penelitian ini untuk mengetahui upaya penegakan disiplin dan hambatan penegakan disiplin bagi PNS di pemerintahan Kota Serang. Teori yang di gunakan yaitu Teori Kewenangan dan Teori Penegakan Hukum Administrasi Negara. Metode yang digunakan yaitu yuridis empiris. Spesifikasi penelitian yang digunakan adalah jenis penelitian deskriptif analisis kualitatif. Sumber data yang digunakan yaitu sumber data sekunder yang dibagi lagi menjadi bagian, yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, dengan teknik pengumpulan data studi pustaka dan studi lapangan. Hasil penelitian yang didapat yaitu Berdasarkan Peraturan Wali Kota Serang Nomor 88 Tahun 2021 Tentang Penegakan Disiplin PNS bahwa dalam hal penegakan disiplin PNS di Kota Serang menjadi kewenangan masing-masing pimpinan dinas terkait. Sejalan dengan teori kewenangan yang menjelaskan kewenangan itu merupakan hak untuk memerintah, memberikan keputusan, dan menentukan kebijakan. Kewenangan itu sendiri dapat diperoleh dengan cara Atribusi, Delegasi, dan Mandat. Selanjutnya hambatan dalam pelaksanaan penegakan disiplin PNS di Kota Serang yaitu karena kurangnya kesadaran diri PNS terkait kedisiplinan, kemudian akibat ketidaksesuaian ekspetasi mereka terkait tugas dan penempatan kerjanya, dan banyak PNS yang memiliki hutang. Penegakan hukum administratif terhadap PNS yang sering telat masuk kerja yaitu mulai dari penundaan kenaikan golongan dan jabatan hingga pemecatan secara tidak hormat. | |||||||||
