Abstract
The services provided by the Regional Government through BKPSDM in the appointment of honorary workers in the education sector, particularly the appointment of non-ASN teachers as Government Employees with a Work Agreement (PPPK), continue to face various challenges and conditional interests. According to Article 66 of Law Number 20 of 2023, non-ASN employees must be restructured no later than December 2024. Therefore, since this law came into effect, government institutions are prohibited from appointing non-ASN employees or any other title besides ASN employees. The problems identified are: How is the implementation of BKPSDM’s role in the structuring of Government Employees with a Work Agreement in Tangerang City? And what legal protection is provided to non-ASN teachers in the structuring of Government Employees with a Work Agreement in Tangerang City, based on Law Number 20 of 2023 concerning the State Civil Apparatus?. Theories used in this study include the theory of government action and the theory of legal protection. The research method applied is empirical juridical, with a descriptive-analytical research specification. The research findings show that BKPSDM of Tangerang City is in the process of structuring and determining the formation for non-ASN employees to participate in the selection of Government Employees with a Work Agreement. A total of 5,186 non-ASN employees will participate in the 2024 PPPK selection, consisting of 2,510 teachers, 1,019 health workers, and 1,657 technical personnel. In conclusion, regarding the structuring of non-ASN employees, the Tangerang City Government through BKPSDM is indeed understaffed to carry out its duties, hence the PPPK structuring must be completed by 2024.

Additional Information: | Pelayanan yang diwujudkan pemerintah daerah BKPSDM dalam pengangkatan tenaga honorer di bidang pendidikan, terutama pengangkatan tenaga guru non-ASN menjadi PPPK masih diwarnai oleh berbagai kendala dan kepentingan yang bersyarat, dalam pasal 66 Undang-Undang Nomor 20 Tahun 2023 pegawai non-ASN wajib menyelesaikan penataannya paling lambat yakni Desember 2024. Sehingga, sejak Undang-Undang ini mulai berlaku, maka Instansi Pemerintah dilarang untuk mengangkat pegawai non- ASN atau nama lainnya selain Pegawai ASN. Identifikasi masalah yaitu, Bagaimana implementasi peran BKPSDM dalam enataan Pegawai Pemerintah dengan Perjanjian Kerja di Kota Tangerang dan Apa perlindungan hukum tenaga guru non-ASN dalam penataan Pegawai Pemerintah dengan Perjanjian Kerja di Kota Tangerang berdasarkan UndangUndang Nomor 20 Tahun 2023 Tentang Aparatur Sipil Negara. Teori yang digunakan yaitu teori tindakan pemerintah dan teori perlindungan hukum. Metode penelitian yang digunakan adalah metode yuridis empiris dan spesifikasi penelitian yang digunakan adalah deskriptif analitis. Hasil penelitian menunjukan BKPSDM Kota Tangerang sedang melakukan penataan dan menentukan formasi pegawai non-ASN untuk mengikuti seleksi Pegawai Pemerintah dengan Perjanjian Kerja, ada 5.186 pegawai non-ASN yang akan mengikuti seleksi PPPK tahun 2024, Adapun rincian formasinya terdiri dari 2.510 guru, 1.019 tenaga kesehatan, dan tenaga teknis sebanyak 1.657 orang. Kesimpulannya dalam hal penataan tenaga non-ASN ini, pemerintah Kota Tangerang melalui Kantor BKPSDM memang kekurangan tenaga kerja untuk melaksanakan tugasnya, maka kemudian terdapat PPPK yang penataannya harus diselesaikan tahun 2024. | |||||||||
