Abstract
The phenomenon of the impact of social modernization, one of which is the decline in marriage rates, has been rampant lately. Facing the problems in this phenomenon, the author will examine how marriage law provides legal certainty and solutions for married couples in dealing with the impact of social modernization in the household. This research uses the theory of legal certainty and the theory of structural functionalism of Talcott Parsons. The results of this study concluded that the real impact of modernization is a decrease in the marriage rate, changes in the marriage law, especially through an increase in the minimum age of marriage passed in Law No. 16 of 2019, aim to provide legal certainty regarding the legal age for marriage, with this phenomenon showing the development of knowledge related to rights and obligations in marriage. And the Kebayoran Baru KUA carries out its role not only as a marriage registrar, but also as a fostering institution for married life. The premarital guidance program and post-marital assistance in the form of cooperation with financial institutions and mediation services, are concrete forms of implementation of Article 1 of the Marriage Law and Article 3 of KHI. This effort is in line with the objectives of marriage law, thus related to this, the creation of a balance between society and law, as in the theory of structural functionalism of Talcott Parsons.

| Additional Information: | Fenomena dampak modernisasi sosial salah satunya adalah penurunan angka perkawinan dan sedang marak terjadi akhir-akhir ini. Mengahadapi permasalahan dalam fenomena ini penulis akan mengkaji bagaimana hukum perkawinan memberikan kepastian hukum dan solusi bagi pasangan suami isteri dalam menghadapi dampak dari modernsisasi sosial dalam rumah tangga. Penelitian ini menggunakan teori kepastian hukum dan teori fungsionalisme struktural talcott parsons. Hasil dari penelitian ini disimpulan bahwa dampak nyata dari modernisasi ini salah adalah penurunan angka perkawinan, Perubahan dalam UU perkawinan, terutama melalui peningkatan usia minimal perkawinan yang disahkan dalam UU No. 16 Tahun 2019, bertujuan untuk memberikan kepastian hukum terkait usia yang sah untuk menikah, dengan adanya fenomena ini memperlihatkan perkembangan pengetahuannya terkait hak dan kewajiban dalam perkawinan. Serta KUA Kebayoran Baru menjalankan perannya tidak hanya sebagai pencata pernikahan, tetapi juga sebagai lembaga pembina kehidupan berumah tangga. Program bimbingan pranikah serta pendampingan pascanikah berupa kerjasama dengan lembaga keuangan dan layanan mediasi, merupakan bentuk nyata implementasi Pasal 1 UU Perkawinan dan Pasal 3 KHI. Upaya ini sejalan dengan tujuan hukum perkawinan, dengan demikian terkait hal tersebut maka terciptanya keseimbangan antara masyarakat dengan hukum, sebagaimana dalam teori fungsionalisme struktural talcott parsons. | |||||||||
