Abstract
The conflict between Palestine and Israel remains a heated and controversial issue because, until now, no solution has been found to resolve the conflict. Palestine requires support and assistance from various countries and international organizations, one of which is the United Nations (UN). Palestine has submitted a request to the UN for membership, but this process has not been successful. After two attempts, Palestine applied in 2011 with draft number (S/2011/592) and in 2024 (S/2024/312), facing opposition due to the veto power held by the United States, which rejected Palestine's bid to join the UN. This veto power has raised questions about its alignment with the mission and goals of the UN. The issues identified in this paper are: How is the implementation of the veto power in the Security Council draft resolution (S/2011/592)? And, is the US veto on Palestine’s UN membership application in accordance with the UN’s mission and goals as outlined in the UN Charter? The theory used by the author is the Principle of Self-Determination and Justice Theory. The method used in this research is normative legal research, with data collection techniques being literature study. The findings of this paper are, first, the US veto power is considered to restrict Palestine’s right to self-determination, and the granting of this veto is unfair to Palestine. Second, the veto power itself is seen as less relevant to the mission and objectives of the UN.

| Additional Information: | Konflik Palestina dengan Israel merupakan isu yang masih hangat dan kontroversial karena sampai saat ini masih belum ada yang menjadi solusi untuk penyelesaian konflik tersebut, Palestina membutuhkan dukungan serta bantuan dari berbagai negara serta organisasi internasional. Salah satunya PBB, yang mana Palestina memberikan surat permohonan kepada PBB untuk masuk kedalam keanggotaan PBB, namun hal ini tidak berakhir mulus setelah dua kali Palestina mengajukan diri pada tahun 2011 dengan nomor draf (S/2011/592) dan 2024 (S/2024/312) sebab adanya hak veto yang diberikan oleh Amerika Serikat terkait yang menolak Palestina untuk dapat bergabung kedalam keanggotaan PBB sehingga hak veto tersebut dipertanyakan keselarasannya dengan tugas dan tujuan dari PBB. Adapun identifikasi masalah dalam tulisan ini yaitu Bagaimana implementasi penggunaan hak veto pada draf resolusi dewan keamanan Perserikatan Bangsa-Bangsa (S/2011/592) dan Apakah hak veto Amerika Serikat pada pendaftaran Palestina terhadap Perserikatan Bangsa-Bangsa merupakan tindakan yang sesuai dengan tugas dan tujuan Perserikatan Bangsa-Bangsa menurut Piagam Perserikatan Bangsa-Bangsa?. Teori yang digunakan oleh penulis adalah Prinsip Self Determination dan Teori Keadilan. Metode yang digunakan dalam penelitian ini adalah metode hukum normatif dengan teknik pengumpulan data yaitu studi kepustakaan. Hasil temuan dari tulisan ini adalah pertama, adanya hak veto yang diberikan oleh Amerika Serikat dinilai membatasi Palestina untuk mendapatkan hak untuk menentukan nasibnya sendiri pemberian hak veto pada permohonan Palestina tidaklah adil kedua, adanya hak veto sendiri dinilai sudah kurang relevan dengan tugas tujuan dari PBB. | |||||||||
