Abstract
Maxim is a Russian web-based online transportation company working in Indonesia. Maxim implements balance vouchers to attract customer interest with a discount on fees in bookings if using balance vouchers, this has an impact on drivers because they feel materially disadvantaged due to reduced income. Identification of the problem, namely how to protect the legal protection for Maxim drivers in Cilegon City who are materially harmed in the use of account balance vouchers used by customers is associated with Article 1365 of the Civil Code and how to be responsible by PT Maxim Kota Cilegon for material losses that have an impact on drivers in the use of account balance vouchers used by customers. The research method is normative-empirical law. The data used in this study are secondary and primary data. Secondary data collection techniques are literature studies and primary data through interviews. The data processing in this study is a literature and field study. The analysis of this study uses a qualitative approach. The existence of this balance voucher is implemented by the central maxim office, the purpose is to attract consumers to use the services in the maxim application and is also intended to be an income for the Company, it can be called "Profit Sharing". The drivers, of course, already know about the existence of Profit Sharing, at the beginning before becoming our partners, they read the cooperation agreement that must be done, the goal is so that the Company can continue to move, so that the system can always be updated, running an applicator to prosper the drivers, of course. Maxim also implemented this deduction in accordance with the rules of article 23 paragraph 1 of Permenhub Number 118 of 2018 concerning tariff arrangements, promos, and freezing of driver-partner accounts.

| Additional Information: | Maxim merupakan perusahaan transportasi online berbasis web Rusia yang bekerja di Indonesia. Maxim menerapkan voucher saldo untuk menarik peminat para customer dengan adanya potongan biaya dalam pemesanan jika menggunakan voucher saldo, hal ini menjadi dampak terhadap para driver karena merasa dirugikan secara meteriil karna berkurangnya pendapatan. Identifikasi masalah yaitu Bagaimana perlindungan hukum untuk driver Maxim di Kota Cilegon yang dirugikan secara materiil dalam penggunaan voucher saldo akun yang digunakan para customer dikaitkan dengan Pasal 1365 KUHPerdata dan Bagaimana upaya tanggung jawab oleh PT Maxim Kota Cilegon atas kerugian materiil yang berdampak kepada para driver dalam penggunaan voucher saldo akun yang digunakan para customer. Metode penelitian ini adalah hukum normatif-empiris. Data yang digunakan dalam penelitian ini adalah data sekunder dan primer. Teknik mengumpulkan data sekunder adalah studi kepustakaan dan data primer melalui wawancara. Pengolahan data dalam penelitian ini adalah studi kepustakaan dan lapangan. Analisis penelitian ini menggunakan pendekatan kualitatif. Adanya voucher saldo ini diterapkan oleh kantor maxim pusat, tujuannya untuk memikat para konsumen agar menggunakan layanan jasa di aplikasi maxim dan juga dimaksudkan untuk menjadi pemasukan bagi Perusahaan, bisa disebut “Profit Sharing”. Para driver tentunya sudah mengetahui perihal adanya Profit Sharing ini, diawal sebelum menjadi mitra kami, mereka membaca perjanjian kerjasama yang harus dilakukan, tujuannya agar Perusahaan dapat terus bergerak, agar system dapat selalu diperbaharui, menjalankan aplikator untuk mensejahterakan para driver tentunya. Maxim pun menerapkan adanya potongan ini sudah mengikuti sesuai aturan pasal 23 ayat 1 Permenhub Nomor 118 Tahun 2018 tentang pengaturan tarif, promo, hingga pembekuan akun mitra pengemudi. | |||||||||
