Abstract
Armed conflicts often involve using Private Military and Security Companies (PMSC) as non-state actors that provide various security and military services. However, legal protection for PMSC personnel in armed conflicts is often debated, especially in complex situations such as the conflict between Russia and Ukraine. The problems are; first, how is the form of legal protection for PMSC personnel in armed conflicts based on the Montreux Document and second, how is the implementation of the Montreux Document on the armed conflict between Russia and Ukraine in the protection of PMSC personnel. The research method that the author uses is normative or doctrinal legal research with descriptive normative research specifications and secondary data sources. The data is collected through a literature study and then analyzed qualitatively. The results of this study can be concluded that the Montreux Document emphasizes the state both as a service user, the country of operation, and the country of origin of PMSCs, to ensure compliance with international humanitarian law so that PMSCs do not lose their protection as civilians. However, the implementation of the Montreux Document in the armed conflict between Russia and Ukraine is difficult for PMSCs such as the Wagner Group due to their non-compliance with international humanitarian law and their often changing roles that make them lose their protection as civilians. The recommendations of this research include the need for the development of more binding international legal instruments to ensure more effective legal protection for PMSC personnel in armed conflicts.

| Additional Information: | Konflik bersenjata sering kali melibatkan penggunaan Private Military and Security Companies (PMSC) sebagai aktor non-negara yang memberikan berbagai layanan keamanan dan militer. Namun, perlindungan hukum bagi personil PMSC dalam konflik bersenjata kerap menjadi perdebatan, terutama dalam situasi kompleks seperti konflik antara Rusia dan Ukraina. Masalahnya adalah ; pertama, bagaimana bentuk perlindungan hukum terhadap personil PMSC dalam konflik bersenjata berdasarkan Montreux Document dan kedua, bagaimana implementasi Montreux Document terhadap konflik bersenjata antara Rusia dan Ukraina dalam perlindungan personil PMSC. Metode penelitian yang penulis gunakan adalah penelitian hukum normatif atau doktrinal dengan spesifikasi penelitian deskriptif normatif dan sumber data sekunder. Pengumpulan data tersebut melalui studi kepustakaan kemudian dianalisis secara kualitatif. Hasil dari penelitian ini dapat disimpulkan bahwa Montreux Document menekankan negara baik sebagai pengguna jasa, negara tempat beroperasi, dan negara asal PMSC, untuk memastikan kepatuhan terhadap hukum humaniter internasional agar PMSC tidak kehilangan perlindungannya sebagai warga sipil. Walapun dalam implementasi Montreux Document dalam konflik bersenjata antara Rusia dan Ukraina sulit diterapkan oleh PMSC seperti, Wagner Group dikarenakan ketidakpatuhan mereka terhadap hukum humaniter internasional dan peran mereka yang sering kali berubah-ubah sehingga mereka kehilangan perlindungan sebagai warga sipil. Rekomendasi penelitian ini mencakup perlunya pengembangan instrumen hukum internasional yang lebih mengikat untuk memastikan perlindungan hukum yang lebih efektif bagi personil PMSC dalam konflik bersenjata. | |||||||||
