Abstract
Law Number 21 of 2000 concerning Trade Unions has guaranteed the rights of workers to establish, join or become administrators of trade unions in order to fight for the rights and interests of workers and improve the welfare of workers and their families. However, in reality it is not easy to implement considering the many restrictions on workers who want to establish, join or become members of a trade union. This thesis raises the problem of the establishment of a trade union by workers at PT Cahaya Subur Prima which is related to Law Number 21 of 2000 concerning Trade Unions and the implementation of freedom of association carried out by trade unions at PT. Cahaya Subur Prima. The research method used by the author is sociological juridical using a case approach. The data collection technique used by the author is direct unstructured oral interviews and literature studies where the data obtained is then analyzed descriptively qualitatively. Based on this study, the results obtained are that the establishment of a trade union at PT. Cahaya Subur Prima has been carried out in accordance with the provisions of Law Number 21 of 2000 concerning Trade Unions which results in legal protection for workers in carrying out their organizational activities both within and outside the company. Implementation of freedom of association at PT. Cahaya Subur Prima has been carried out by the labor union in accordance with the provisions of Law Number 21 of 2000 concerning Labor Unions where the labor union provides assistance to its members in resolving problems resulting from the establishment of the labor union at PT. Cahaya Subur Prima until a joint agreement is reached between the labor union and the employer. However, the severance pay received by the workers is not in accordance with the provisions of Law Number 6 of 2023 concerning Job Creation. The workers have agreed internally to accept the severance pay which is caused by several factors, one of which is that the time of the joint agreement made is close to the Eid al-Fitr celebration. The workers only get IDR 100,000,000.00 (one hundred million rupiah) for 58 workers.

Additional Information: | Undang-Undang Nomor 21 Tahun 2000 Tentang Serikat Pekerja telah menjamin hak pekerja dalam mendirikan, bergabung atau menjadi pengurus serikat pekerja guna memperjuangkan hak dan kepentingan pekerja serta meningkatkan kesejahteraan pekerja dan keluarganya. Namun pada kenyataannya tidak mudah untuk dilaksanakan mengingat masih banyaknya pembatasan terhadap pekerja yang hendak mendirikan, bergabung atau menjadi anggota serikat pekerja. Dalam skripsi ini mengangkat permasalahan mengenai pendirian serikat pekerja oleh pekerja di PT Cahaya Subur Prima yang dihubungkan dengan Undang-Undang Nomor 21 Tahun 2000 Tentang Serikat Pekerja serta penerapan kebebasan berserikat yang dilakukan oleh serikat pekerja di PT. Cahaya Subur Prima. Metode penelitian yang digunakan oleh penulis yaitu yuridis sosiologis dengan menggunakan pendekatan kasus. Teknik pengumpulan data yang digunakan penulis yaitu wawancara langsung secara lisan tidak terstruktur dan studi pustaka dimana data yang diperoleh kemudian di analisis secara deskriptif kualitatif. Berdasarkan penelitian ini diperoleh hasil bahwa pendirian serikat pekerja di PT. Cahaya Subur Prima telah dilakukan sesuai dengan ketentuan Undang-Undang Nomor 21 Tahun 2000 Tentang Serikat Pekerja yang mana hal tersebut mengakibatkan perlindungan hukum bagi pekerja dalam menjalankan kegiatan organisasinya baik di dalam perusahaan maupun di luar perusahaan. Penerapan kebebasan berserikat di PT. Cahaya Subur Prima telah dilakukan oleh serikat pekerja sesuai dengan ketentuan Undang-Undang Nomor 21 Tahun 2000 Tentang Serikat Pekerja dimana serikat pekerja melakukan pendampingan kepada para anggota nya dalam melakukan penyelesaian masalah akibat berdirinya serikat pekerja di PT. Cahaya Subur Prima hingga terjadinya perjanjian bersama antara pihak serikat pekerja dengan pihak pengusaha. Namun pesangon yang diterima oleh pekerja tidak sesuai dengan ketentuan Undang-Undang Nomor 6 Tahun 2023 Tentang Cipta Kerja. Para pekerja telah menyepakati secara internal untuk menerima pesangon tersebut yang mana disebabkan oleh beberapa faktor salah satunya waktu perjanjian bersama yang dilakukan sudah mendekati perayaan hari Raya Idul Fitri. Para pekerja hanya mendapatkan Rp 100.000.000,00 (seratus juta rupiah) untuk 58 orang pekerja. | |||||||||
