Abstract

Legal protection for rape victims who undergo abortion is a complex issue, involving legal, moral, social, and health aspects. From a victimological perspective, rape victims should be seen as vulnerable individuals requiring special protection. A legal approach that is sensitive to the victim includes the recognition of their rights, including the right to access safe and legal abortion services as stipulated in Law No. 36 of 2009 on Health and Government Regulation No. 61 of 2014 on Reproductive Health. The victimological perspective emphasizes the importance of physical and psychological recovery for victims and the elimination of social stigma often associated with abortion resulting from sexual violence. The law allowing abortion in cases of rape, under specific conditions such as pregnancies no longer than 40 days old, is designed to protect victims from further medical and psychological impacts. However, the implementation of this regulation often faces challenges, including procedural barriers, low legal awareness, societal stigma, and inadequate support from law enforcement. According to the theory of victims' rights protection, victims are entitled to justice, humane treatment, and services that support their recovery. Meanwhile, the theory of law enforcement highlights the necessity for consistency in the application of the law by law enforcement officials to ensure victims can access their rights without discrimination. With a victimological approach, legal protection for rape victims who undergo abortion must prioritize the victims, ensuring substantive justice and providing comprehensive support through collaboration between legal systems, medical professionals, and society. This approach is crucial in creating a legal system that not only punishes perpetrators but also holistically restores and protects the victims.

Additional Information: Perlindungan hukum terhadap korban perkosaan yang melakukan aborsi merupakan isu yang kompleks karena melibatkan aspek hukum, moral, sosial, dan kesehatan. Dalam perspektif viktimologi, korban perkosaan harus dipandang sebagai individu yang rentan dan memerlukan perlindungan khusus. Pendekatan hukum yang sensitif terhadap korban mencakup pengakuan atas hak-hak mereka, termasuk hak untuk mendapatkan layanan aborsi yang aman dan legal sesuai dengan Undang-Undang No. 36 Tahun 2009 tentang Kesehatan dan Peraturan Pemerintah No. 61 Tahun 2014 tentang Kesehatan Reproduksi. Perspektif viktimologi menekankan pentingnya pemulihan fisik dan psikologis korban serta penghapusan stigma sosial yang sering melekat pada tindakan aborsi akibat kekerasan seksual. Hukum yang memperbolehkan aborsi akibat perkosaan, dengan syarat tertentu seperti usia kehamilan tidak lebih dari 40 hari, dirancang untuk melindungi korban dari dampak lanjutan baik secara medis maupun psikologis. Namun, implementasi aturan ini sering kali terhambat oleh kendala prosedural, rendahnya kesadaran hukum, stigma masyarakat, dan kurangnya dukungan dari penegak hukum. Dalam teori perlindungan hak-hak korban, korban memiliki hak atas keadilan, perlakuan manusiawi, dan layanan yang mendukung pemulihan mereka. Sementara itu, teori penegakan hukum menyoroti perlunya konsistensi dalam pelaksanaan hukum oleh aparat penegak hukum agar korban dapat mengakses hak-haknya tanpa diskriminasi. Dengan pendekatan viktimologi, perlindungan hukum terhadap korban perkosaan yang melakukan aborsi harus menempatkan korban sebagai pusat perhatian, memastikan keadilan substantif, serta memberikan dukungan yang komprehensif melalui kolaborasi antara hukum, tenaga medis, dan masyarakat. Hal ini penting untuk menciptakan sistem hukum yang tidak hanya menghukum pelaku, tetapi juga memulihkan dan melindungi korban secara holistik.
