Abstract

Protection and law enforcement in Indonesia in the health sector still appear to be very poor. Such as poor health services, medical procedures that do not comply with Standard Operating Procedures, errors in administering medication, ignoring patient complaints, errors in identifying client problems, negligence in the operating room, the emergence of cases of pressure ulcers during treatment, negligence and patient safety are factors that cause these cases. Cases of negligence committed by medical personnel. Identification of the problem in this research is: What is the urgency of forming implementing regulations for Law Number 17 of 2023 concerning Health as a form of legal protection for patients? And how is the punishment applied for medical personnel and/or health workers who commit negligence? The theories used are Legal Protection Theory and Criminal Law Policy Theory. The method used is normative juridical, with a qualitative type of research using a statutory approach sourced from primary, secondary and tertiary data. The results of the research found that there are no further articles or regulations that regulate the definition, qualifications, and types of malpractice acts in the health sector and procedures for seeking criminal responsibility and proof. Therefore, the issuance of regulations implementing Law Number 17 of 2023 concerning Health is urgent. Suggestions that can be made, for medical personnel to carry out their profession more carefully in carrying out medical actions or services for patients, for the Government to immediately form Implementing Regulations for Law Number 17 of 2023 concerning Health which must contain clearer rules regarding the implementation of the law as well as a more detailed explanation regarding malpractice. Furthermore, criminal responsibility must prioritize and determine perpetrators of criminal acts as subjects of criminal law in statutory provisions.

Additional Information: Perlindungan serta penegakan hukum di Indonesia pada bidang kesehatan terlihat masih sangat kurang baik. Seperti pelayanan kesehatan yang kurang baik, tindakan medis yang tidak sesuai Standar Operasional Prosedur, kesalahan pemberian obat, mengabaikan keluhan pasien, kesalahan mengidentifikasi masalah klien, kelalaian diruang operasi, timbulnya kasus dekubitus selama dalam perawatan, kelalaian dan keselamatan pasien menjadi faktor penyebab terjadinya kasus-kasus kelalaian yang dilakukan oleh tenaga medis. Identifikasi masalah dalam penelitian ini yaitu Bagaimana Urgensi Dibentuknya Peraturan Pelaksana Atas Undang-Undang Nomor 17 Tahun 2023 Tentang Kesehatan Sebagai Bentuk Perlindungan Hukum Bagi Pasien? Serta Bagaimana Penerapan Pemidanaan Bagi Tenaga Medis dan/atau Tenaga Kesehatan Yang Melakukan Kelalaian? Teori yang digunakan ialah Teori Perlindungan Hukum dan Teori Kebijakan Hukum Pidana. Metode yang digunakan ialah yuridis normatif, dengan jenis penelitian kualitatif menggunakan pendekatan perundang-undangan yang bersumber dari data primer, sekunder dan tersier. Hasil penelitian ditemukan bahwa, belum adanya pasal atau peraturan lebih lanjut yang mengatur mengenai definisi, kualifikasi, serta jenis-jenis tindakan malpraktek yang ada dalam bidang kesehatan dan prosedur memintakan pertanggungjawaban pidana serta pembuktiannya. Oleh karena itu penerbitan peraturan pelaksana Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan ini menjadi urgen. Saran yang dapat dilakukan, untuk tenaga medis agar menjalankan profesinya lebih berhati-hati dalam melakukan tindakan atau pelayanan medik terhadap pasien, untuk Pemerintah agar segera membentuk Peraturan Pelaksana Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan yang harus memuat aturan yang lebih jelas perihal pelaksanaan atas undang-undang tersebut serta penjelasan lebih detail perihal malpraktek. Selanjutnya dalam pertanggungjawaban pidana harus mengedepankan dan menetapkan pelaku tindak pidana sebagai subyek hukum pidana dalam ketentuan perundang-undangan.
