Abstract

The government in Indonesia, in order to guarantee the safety, health, comfort and convenience of building users, before a building can be said to be suitable, the building is required to have a Building Functional Worthiness Certificate (SLF). However, in implementing the authority of the Department of Housing, Settlements and Land, it often faces obstacles in the form of operationalization, data collection on buildings that do not yet have a Certificate of Functional Appropriateness, and the absence of an increase in technical assessment capacity. Based on this background, the researcher identified two problems, namely how the authority of the Housing, Settlement and Land Service is implemented regarding the process of issuing certificates of building worthiness in Tangerang City and what are the obstacles to the implementation of the authority of the Housing, Settlement and Land Service in the process of issuing certificates of building worthiness. in Tangerang City. The theories used are the theory of authority and the theory of government action. This research uses empirical juridical. The type of research in this research is descriptive analytical, using primary and secondary data sources. The data collection techniques for this research are library and field research. The research results showed that the authority of the Department of Housing, Settlements and Land in the process of issuing certificates of functional worthiness has not been fully implemented. Based on factors according to the theory of government action in the implementation of article 282 paragraph (2) Government Regulation Number 16 of 2021 concerning Implementing Regulations of Law Number 28 of 2002 concerning Buildings, Incompatibility between the Building Management Information System and Government Regulation Number 16 of 2021 concerning Regulations Implementation of Law Number 28 of 2002 concerning Buildings. The incompleteness and lack of verification of building data indicates problems in data management by the Housing, Settlement and Land Service. And there is no uniform format for technical assessment reports. Based on Stroink and Steenbeek's theory of authority, the issuance of this SLF involves delegation and efficient exercise of authority. Overall, the Technical Service has demonstrated significant progress in managing administrative authority and improving compliance, although challenges in improving processes and adapting systems still need to be overcome.

Additional Information: Pemerintah di Indonesia dalam rangka menjamin keselamatan, kesehatan, kenyamananan, dan kemudahan pengguna bangunan gedung, sebelum bangunan dapat dikatakan layak maka Bangunan Gedung diwajibkan memiliki Sertifikat Laik Fungsi (SLF) bangunan gedung. Namun, dalam pelaksanaan kewenangan Dinas Perumahan, Pemukiman, dan Pertanahan seringkali menghadapi hambatan berupa Pengoperasionalannya, Pendataan Bangunan Gedung yang belum memiliki Sertifikat Laik Fungsi, dan belum adanya peningkatan kapasitas pengkajian teknis. Berdasarkan latar belakang tersebut, peneliti mengambil dua identifikasi masalah yaitu Bagaimana Pelaksanaan Kewenangan Dinas Perumahan, Pemukiman, dan Pertanahan Terhadap Proses Penerbitan Sertifikat Laik Fungsi Bangunan di Kota Tangerang dan Bagaimana Hambatan Pelaksanaan Kewenangan Dinas Perumahan, Pemukiman, dan Pertanahan Terhadap Proses Penerbitan Sertifikat Laik Fungsi Bangunan di Kota Tangerang. Teori yang digunakan adalah teori kewenangan dan teori tindakan pemerintah. Penelitian ini menggunakan yuridis empiris. Jenis penelitian pada penelitian ini yaitu deskriptif analitis, menggunakan sumber data primer dan sekunder. Teknik pengumpulan data penelitian ini yaitu penelitian kepustakaan dan lapangan. Hasil penelitian diperoleh kewenangan Dinas Perumahan, Pemukiman, dan Pertanahan dalam proses penerbitan sertifikat laik fungsi belum sepenuhnya terjalankan. Berdasarkan faktor menurut teori tindakan pemerintah implementasi dari pasal 282 ayat (2) Peraturan Pemerintah Nomor 16 Tahun 2021 Tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 Tentang Bangunan Gedung, Ketidaksesuaian antara Sistem Informasi Manajemen Bangunan Gedung dengan Peraturan Pemerintah Nomor 16 Tahun 2021 Tentang Peraturan Pelaksanaan Undang-Undang Nomor 28 Tahun 2002 Tentang Bangunan Gedung. Ketidaklengkapan dan kurangnya verifikasi data bangunan gedung menunjukkan masalah dalam pengelolaan data oleh Dinas Perumahan, Pemukiman, dan Pertanahan. Serta belum adanya Penyeragaman format laporan pengkajian teknis. Berdasarkan teori kewenangan Stroink dan Steenbeek, penerbitan SLF ini melibatkan delegasi dan pelaksanaan kewenangan yang efisien. Secara keseluruhan, Dinas Teknis telah menunjukkan kemajuan yang signifikan dalam pengelolaan kewenangan administratif dan peningkatan kepatuhan, meskipun tantangan dalam penyempurnaan proses dan penyesuaian sistem masih perlu diatasi.
