Abstract
PT. Astra Honda Motor is one of the motor vehicle manufacturing businesses that is in great demand among the public and is the largest manufacturing and distributor company in Indonesia and the third largest automotive manufacturer of motor vehicles in the world. Then in its development PT. Astra Honda Motor experienced an incident in the case of a Honda motorbike's Ehanched Smart Architecture Frame (eSAF) which was suspected to be rusty, even porous, which resulted in many consumer protests asking for responsibility. The identification of the problem in this research is how PT is held accountable. Astra Honda Motor towards consumers regarding damage to the Ehanched Smart Architecture Frame (eSAF) frame and how to attempt a legal settlement between PT. Astra Honda Motor towards consumers in terms of Law Number 8 of 1999 concerning Consumer Protection. The theories used are Legal Responsibility Theory and Consumer Protection Theory with normative juridical methods. The research specifications used are qualitative research. The data source used is a secondary data source supported by primary data, with data collection techniques in the form of library studies and field studies. The research results obtained are that PT Astra Honda Motor is obliged to provide compensation if there is damage to the Esaf frame on a motorized vehicle. This compensation is as stated in Article 19 Paragraph (2) UUPK which explains that compensation includes refund of costs, maintenance costs if an accident occurs, as well as compensation money. Then, regarding the resolution of this dispute, it is carried out by means of non-litigation settlement through BPSK by means of mediation, arbitration and conciliation. And it can be resolved through litigation through the courts. Researchers suggest that business actors can provide a framework guarantee for the products they will sell. And in an effort to resolve disputes, it is better to resolve them peacefully by paying attention to the applicable provisions and not harming either party.

Astra Honda Motor merupakan salah satu pelaku usaha pembuatan kendaraan bermotor yang banyak diminati oleh kalangan masyarakat dan menjadi perusahaan sebagai perusahaan manufakturing dan distributor terbesar di Indonesia serta produsen otomotif kendaraan bermotor terbesar ke tiga di dunia. Kemudian dalam perkembangannya PT. Astra Honda Motor mengalami insiden kasus rangka Ehanched Smart Architecture Frame (eSAF) motor Honda yang diduga mengalami karat, bahkan keropos yang menuai banyak protes konsumen untuk meminta pertanggungjawaban. Identifikasi masalah pada penelitian ini adalah Bagaimana pertanggungjawaban PT. Astra Honda Motor terhadap konsumen dalam kerusakan rangka Ehanched Smart Architecture Frame (eSAF) serta Bagaimana upaya penyelesaian hukum antara PT. Astra Honda Motor terhadap Konsumen ditinjau dari Undang-Undang Nomor 8 tahun 1999 Tentang Perlindungan Konsumen. Teori yang digunakan yaitu Teori Pertanggungjawaban Hukum dan Teori Perlindungan Konsumen dengan Metode yuridis normatif. Spesifikasi penelitian yang digunakan adalah jenis penelitian kualitatif. Sumber data yang digunakan adalah sumber data sekunder yang ditunjang data primer, dengan teknik pengumpulan data berupa studi pustaka dan studi lapangan. Analisis data yang digunakan adalah deskriptif analisis. Hasil penelitian yang didapat yaitu PT Astra Honda Motor wajib melakukan ganti rugi apabila terjadi adanya kerusakan rangka Esaf pada kendaraan bermotor. Ganti rugi tersebut, sebagaimana termaktub dalam Pasal 19 Ayat (2) UUPK yang menjelaskan bahwa ganti rugi meliputi adanya pengembalian biaya, biaya perawatan apabila terjadi kecelakaan, serta uang santunan. Kemudian terkait penyelasain sengeta tersebut dalam dilakukan dengan cara penyelesaian secara non-ligitasi melalui BPSK dengan cara mediasi, arbitrase dan konsiliasi. Serta dapat dilakukan penyelesaian secara litigasi melalui pengadilan. Saran peneliti pelaku usaha dapat memberikan garansi rangka pada produk yang akan dijual. Serta dalam upaya penyelesaian sengketa lebih baik diselesaikan secara damai dengan memperhatikan ketentuan yang berlaku dan tidak merugikan salah satu pihak. | |||||||||
