Abstract
Article 28D, paragraph (2) of the Constitution of the Republic of Indonesia asserts that every person has the right to work and to receive fair and proper remuneration and treatment in employment. However, Indonesian citizens working as domestic workers still experience unfair treatment and lack of protection, even to the extent of violence. This situation highlights a significant disparity between what is mandated by the constitution and the reality faced by domestic workers in Indonesia. On the other hand, local governments have authority over labor matters. The problems identified in this thesis are: what are the provincial local government’s authorities regarding the supervision and protection of domestic workers? And what efforts are being made by the provincial local government to address the issues faced by domestic workers? This thesis employs the theory of authority and supervision. The method used in this thesis is normative juridical, with the research specification being descriptive-analytical, and the data sources used are secondary data. The research findings are: 1) Domestic workers have different characteristics from formal workers. 2) There is a need for regulations that govern the rights and protection of domestic workers. The conclusions from this study are: 1) Protection for domestic workers can be carried out by the provincial government. 2) Issuing regional regulations specifically governing domestic workers. My suggestions include establishing a supervisory network or creating a reporting procedure.

| Additional Information: | Pasal 28D ayat (2) Undang-undang Dasar Negara Republik Indonesia yang menegaskan bahwa setiap orang berhak untuk bekerja serta mendapat imbalan dan perlakuan yang adil dan layak dalam hubungan kerja. Sedangkan disaat bersamaan warga negara Indonesia yang berkerja sebagai PRT masih mengalami perlakuan kurang adil dan kurangnya perlindungan, bahkan hingga kekerasan. Situasi ini menunjukkan adanya ketimpangan yang signifikan antara apa yang diamanatkan oleh konstitusi dan realitas yang dihadapi oleh PRT di Indonesia. Di sisi lain, pemerintah daerah mimiliki kewenangan terhadap tenaga kerja. Identifikasi masalah pada skripsi ini adalah bagaimana kewenangan pemerintah daerah provinsi terhadap pengawasan dan perlindungan PRT? Dan bagaimana upaya pemerintah daerah provinsi dalam mengatasi permasalahan PRT? Teori yang digunakan dalam skripsi ini menggunakan teori kewenangan dan pengawasan. Metode yang digunakan dalam skripsi ini adalah metode yuridis normatif dengan spesifikasi penelitian adalah deskritif analitis dan sumber data yang digunakan adalah sumber data sekunder. Adapun hasil penelitian 1). PRT memiliki karakteristik yang berbeda dengan pekerja formil. 2). Perlu adanya aturan bagi PRT yang mengatur hak dan perlindungan. Kesimpulan dari tulisan ini 1). Perlindungan terhadap PRT dapat dapat dilakukan oleh daerah provinsi 2). mengeluarkan peraturan daerah yang khusus mengatur PRT. Saran saya membentuk jejaring pengawasan atau membuat prosedur pelaporan. | |||||||||
