Abstract

Humans' right to embrace religion is one of the human rights (HAM) that they are obliged to obtain without any reduction. It is stated in Article 22 of the Human Rights Law number 2: "The state guarantees the freedom of every person to embrace their own religion and to worship according to their religion and beliefs." However, religious communities still find it difficult to carry out their worship, one of which is the case regarding the closure of the entrance to the Al-Istiqomah Mosque by the Le Dian Hotel in Serang District, Serang City, Banten. The road access was closed because the land around the Al-Istiqomah Mosque is owned by the Le Dian Hotel. However, the mosque has waqf status so that local residents carry out reclaiming actions to be able to carry out worship and also maintain it. This research was conducted with the aim of finding out the reclaiming actions carried out by residents in defending the Al-Istiqomah Mosque using qualitative case study research methods and the Contentious Politics theoretical approach. As a result of the research carried out, it was found that the reclaiming action carried out by the residents was appropriate, by building stairs to enter the Al-Istiqomah Mosque without tearing down/destroying the fence that was in the way. And residents also asked for help from the Serang City Ministry of Religion to help with the tension between residents and the hotel.

Additional Information:	Hak manusia untuk memeluk agama merupakan salah satu hak asasi manusia (HAM) yang wajib mereka dapatkan tanpa adanya pengurangan. Tercantum pada Pasal 22 UU HAM nomor 2 : “Negara menjamin kemerdekaan setiap orang memeluk agamanya masing-masing dan untuk beribadat menurut agamanya dan kepercayaannya itu.”. Namun masyarakat beragama masih merasa kesulitan saat ingin melaksanakan ibadah, salah satunnya yaitu kasus mengenai penutupan akses jalan masuk ke Masjid Al-Istiqomah oleh pihak Hotel Le Dian di Kecamatan Serang, Kota Serang, Banten. Penutupan akses jalan tersebut dilakukan karena tanah yang berada di sekitar Masjid Al-Istiqomah dimiliki oleh pihak Hotel Le Dian. Namun masjid tersebut memiliki status wakaf sehingga warga sekitar melakukan aksi reklaiming untuk dapat melaksanakan ibadah dan juga mempertahankannya. Penelitian ini dilakukan dengan tujuan untuk mengetahui aksi reklaiming yang dilakukan oleh warga dalam mempertahankan Masjid Al-Istiqomah dengan menggunakan metode penelitian kualitatif studi kasus dan pendekatan teori Contentious Politics. Hasil dari penelitian yang dilakukan, diketahui bahwa aksi reklaiming yang dilakukan oleh warga tepat dilakukan, dengan membangun tangga untuk dapat masuk ke dalam Masjid Al-Istiqomah tanpa merobohkan/menghancurkan pagar yang menghalangi. Dan warga juga meminta bantuan kepada Kementerian Agama Kota Serang untuk dapat membantu persoalan ketegangan yang terjadi antara waga dengan pihak hotel.
