Abstract
BUMDes Kramat Jati Village as the economic driving force in the village for public welfare, but during its implementation it has not been achieved at all receive guidance from the Serang Regency Regional Government. The identification of the problem in this research is, how is the implementation of regional government authority in developing Village-Owned Enterprises (BUMDes) in Kramat Jati Village, Serang Regency as an effort to improve community welfare based on Law Number 6 of 2014 concerning Villages? and what are the obstacles to implementing regional government authority in developing BUMDes Kramat Jati Village, Serang Regency as an effort to improve community welfare based on Law Number 6 of 2014 concerning Villages? The theories used are the theory of authority and the theory of legal effectiveness. The research method used is empirical juridical using primary data and secondary data. The results of the research obtained are that the implementation of BUMDes development in Kramat Jati Village by the Regional Government of Serang Regency is an attribution authority, but it is not implemented, this is because the guidance carried out by the Regional Government of Serang Regency is only through APDESI meetings in only a few villages, as the regulations should be, so the law was declared ineffective. The obstacles faced by the Serang Regency DPMD service and the Kramat Jati Village Government are the large number of BUMDes in Serang Regency which does not match the quantity of service employees, the absence of financial support, as well as the mindset of the community and its human resources who are still unfamiliar with BUMDes itself. The suggestion is that the regional government should be more intensive in socializing BUMDes in every sub-district in Serang Regency so that guidance is carried out evenly across all villages.

| Additional Information: | BUMDes Desa Kramat Jati sebagai motor penggerak ekonomi di desa untuk kesejahteraan masyarakat, namun selama pelaksanaannya belum sama sekali mendapatkan pembinaan oleh Pemerintah Daerah Kabupaten Serang. Identifikasi masalah dalam penelitian ini yaitu, bagaimana pelaksanaan kewenangan pemerintah daerah dalam pembinaan Badan Usaha Milik Desa (BUMDes) Desa Kramat Jati Kabupaten Serang sebagai upaya meningkatkan kesejahteraan masyarakat berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa? dan apakah hambatan pelaksanaan kewenangan pemerintah daerah dalam pembinaan BUMDes Desa Kramat Jati Kabupaten Serang sebagai upaya meningkatkan kesejahteraan masyarakat berdasarkan Undang-Undang Nomor 6 Tahun 2014 tentang Desa? Teori yang digunakan yaitu teori kewenangan dan teori efektivitas hukum. Metode penelitian yang digunakan adalah yuridis empiris dengan menggunakan data primer dan data sekunder. Hasil penelitian yang didapat adalah pelaksanaan pembinaan BUMDesdi Desa Kramat Jati oleh Pemerintah Daerah Kabupaten Serang merupakan kewenangan atribusi, akan tetapi tidak terlaksana, hal ini dikarena pembinaan yang dilakukan oleh Pemerintah Daerah Kabupaten Serang hanya melalui pertemuan APDESI oleh beberapa desa saja, sebagaimana aturan yang seharusnya, sehingga dinyatakan hukumnya tidak efektif. Hambatan yang dihadapi oleh dinas DPMD Kabupten Serang dan Pemerintah Desa Kramat Jati yaitu jumlah BUMDes di Kabupaten Serang yang banyak dan tidak sesuai dengan kuantitas pegawai dinas, tidak adanya dukungan dana finansial, serta pola pikir masyarakat dan sumber daya manusianya yang masih awam tentang BUMDes itu sendiri. Saran, pemerintah daerah seharusnya lebih intensif mensosialisasikan BUMDes disetiap kecamatan di Kabupaten Serang agar pembinaan yang dilakukan merata ke semua desa. | |||||||||
