Abstract
The form of implementation of intellectual property-based financing schemes is regulated in Law Number 28 of 2014 concerning Copyright and in detail elaborated in Government Regulation Number 24 of 2022 concerning the Creative Economy. This regulation is considered positive in efforts to develop creative economy MSMEs which generally have limitations in obtaining financing, one of which is Batik Krakatoa Cilegon, which already has copyright intellectual property but is still not maximally used. The problem identification in this research is how is the implementation of the intellectual property valuation of contemporary batik Krakatoa as an object of fiduciary guarantee for financing the development of MSMEs in Cilegon City? And how can the assessment protect the creators of Krakatoa contemporary batik in the development of creative economy MSMEs? The theories used in this research are legal development theory and legal protection theory. The research method used is the normative-empirical juridical method with research specifications, namely the applicability of law in the form of the process of working law in society. The data sources used in this research are secondary data and primary data using data collection techniques, namely literature studies and field studies in the form of interviews which are then analyzed qualitatively. The results of this study indicate that the valuation of contemporary batik Krakatoa copyright has fulfilled the juridical and physical analysis, but the implementation of economic valuation cannot be done because there is no intellectual property valuation standard. The absence of a secondary market is also an obstacle because liquidation of intellectual property fiduciary guarantees is difficult. The ineffectiveness of the economic valuation of intellectual property has not been able to protect the creator of batik Krakatoa as a fiduciary guarantee. The local government has a role in facilitating the creative economic development of batik Krakatoa, but it needs to play a greater role in maximizing the facilitation of intellectual property marketing.

| Additional Information: | Bentuk implementasi skema pembiayaan berbasis kekayaan intelektual diatur dalam Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta dan secara rinci dijabarkan dalam Peraturan Pemerintah Nomor 24 Tahun 2022 tentang Ekonomi Kreatif. Peraturan ini dinilai positif dalam upaya pengembangan UMKM ekonomi kreatif yang umumnya memiliki keterbatasan dalam mendapatkan pembiayaan salah satunya batik Krakatoa Cilegon yang sudah memiliki kekayaan intelektual hak cipta namun masih belum digunakan secara maksimal. Identifikasi masalah dalam penelitian ini adalah bagaimana implementasi penilaian kekayaan intelektual batik kontemporer Krakatoa sebagai objek jaminan fidusia untuk pembiayaan pengembangan UMKM di Kota Cilegon? Dan bagaimana penilaian tersebut dapat melindungi pencipta batik kontemporer Krakatoa dalam pengembangan UMKM ekonomi kreatif? Teori yang digunakan dalam penelitian ini adalah teori pembangunan hukum dan teori perlindungan hukum. Metode penelitian yang digunakan adalah metode yuridis normatif-empiris dengan spesifikasi penelitian yaitu keberlakuan hukum berupa proses bekerjanya hukum dalam masyarakat. Sumber data yang digunakan pada penelitian ini yaitu data sekunder dan data primer dengan menggunakan teknik pengumpulan data yaitu studi kepustakaan dan studi lapangan berupa wawancara yang kemudian dianalisis secara kualitatif. Hasil penelitian ini menunjukkan bahwa penilaian hak cipta batik kontemporer Krakatoa sudah memenuhi analisis secara yuridis dan fisik, namun implementasi penilaian secara ekonomi belum bisa dilakukan karena belum adanya standar penilaian kekayaan intelektual. Ketiadaan pasar sekunder juga menjadi penghambat karena likuidasi atas jaminan fidusia kekayaan intelektual sulit dilakukan. Belum efektifnya penilaian ekonomi kekayaan intelektual menyebabkan belum bisa melindungi Pencipta batik Krakatoa dalam hal sebagai jaminan fidusia. Pemerintah daerah memiliki peran dalam fasilitasi pengembangan ekonomi kreatif batik Krakatoa, namun perlu untuk lebih berperan dalam memaksimalkan fasilitasi pemasaran kekayaan intelektual. | |||||||||
