Abstract

A Land Deed Making Official (PPAT) is a public official who is given the authority by the state to make authentic deeds regarding certain legal acts, especially those relating to land rights and Ownership Rights to Flat Units (HMSRS). PPAT acts as a partner of the National Land Agency (BPN) in carrying out land registration. The task of the Land Deed Drafting Officer (PPAT) is to make an Authentic Deed using the procedures determined by statutory provisions, register the Deed at the National Land Agency Office, provide legal advice and other services. In the process of making a Land Sale and Purchase Deed, the Land Deed Making Officer (PPAT) is obliged to make the Deed honestly, correctly and thoroughly. A Temporary Land Deed Making Officer (Temporary PPAT) is an official appointed because of his position to carry out PPAT duties by making PPAT deeds in areas where there are not enough PPATs. Temporary Land Deed Making Officials (PPATS) are usually appointed from among the subdistrict heads and village heads. The duties and authority of the Temporary Land Deed Making Official are the same as the duties and authority of the Land Deed Making Official (PPAT). The difference between a Land Deed Making Official (PPAT) and a Temporary Land Deed Making Official (PPATS), namely, the Land Deed Making Official (PPAT) is appointed by the Minister of Agrarian Affairs and Spatial Planning (ATR/BPN) based on a proposal from the Central Executive Board of the Association of Indonesian Land Deed Making Officials. (MP3AT), while the Temporary Land Deed Making Officer (PPATS) is appointed by the Head of the Provincial Regional Office of the National Land Agency (BPN) based on a proposal from the Head of the Regency/City Land Office. In making a Land Sale and Purchase Deed, PPAT and PPATS must have responsibilities such as accuracy, caution and vigilance with the documents. PPAT and PPATS in making the Deed of Sale and Purchase of Land also experienced problems such as lack of documents for the requirements for making the Deed of Sale and Purchase of Land, non-payment of taxes, one of the parties could not be present to sign before the PPAT.

Additional Information:	Pejabat Pembuat Akta Tanah (PPAT) adalah pejabat umum yang diberi kewenangan oleh negara untuk membuat akta otentik mengenai perbuatan hukum tertentu, khususnya yang berkaitan dengan hak atas tanah dan Hak Milik Atas Satuan Rumah Susun (HMSRS). PPAT berkedudukan sebagai mitra Badan Pertanahan Nasional (BPN) dalam melaksanakan pendaftaran tanah. Tugas Pejabat Pembuat Akta Tanah (PPAT) adalah membuat Akta Otentik dengan tata cara yang sudah ditentukan oleh ketentuan perundang-undangan, mendaftarkan Akta ke Kantor Badan Pertanahan Nasional, memberikan nasehat hukum dan pelayanan lainnya. Dalam proses pembuatan Akta Jual Beli Tanah Pejabat Pembuat Akta Tanah (PPAT) wajib membuat Akta tersebut secara jujur, benar, dan teliti. Pejabat Pembuat Akta Tanah Sementara (PPAT Sementara) adalah pejabat yang ditunjuk karena jabatannya untuk melaksanakan tugas PPAT dengan membuat akta PPAT di daerah yang belum cukup terdapat PPAT. Pejabat Pembuat Akta Tanah Sementara (PPATS) biasanya ditunjuk dari kalangan Camat dan Kepala Desa. Tugas dan wewenang dari Pejabat Pembuat Akta Tanah Sementara sama dengan tugas dan wewenang Pejabat Pembuat Akta Tanah (PPAT). Perbedaan Pejabat Pembuat Akta Tanah (PPAT) dengan Pejabat Pembuat Akta Tanah Sementara (PPATS) yakni, Pejabat Pembuat Akta Tanah (PPAT) ditunjuk oleh Menteri Agraria dan Tata Ruang (ATR/BPN) berdasarkan usulan dari Majelis Pengurus Pusat Persatuan Pejabat Pembuat Akta Tanah Indonesia (MP3AT), sedangkan Pejabat Pembuat Akta Tanah Sementara (PPATS) ditunjuk oleh Kepala Kantor Wilayah Badan Pertanahan Nasional (BPN) Provinsi berdasarkan usulan dari Kepala Kantor Pertanahan Kabupaten/Kota. Dalam pembuatan Akta Jual Beli Tanah PPAT dan PPATS harus memiliki tanggung jawab seperti ketelitian, kehati-hatian dan kewaspadaan terhadap dokumen. PPAT dan PPATS dalam pembuatan Akta Jual Beli tanah juga mengalami kendala-kendala seperti kurangnya dokumen untuk persyaratan pembuatan Akta Jual Beli Tanah, belum bayar pajak, salah satu pihak tidak bisa hadir untuk tandatangan dihadapan PPAT.
