Abstract
One of the cross-traffic violations that is often found in the community and becomes one of the factors of decreasing speed of vehicles is lying parking which is often mixed in the shoulders of the road, large vehicles that park falsely in the arms of the streets of the city or develop, this phenomenon takes place on the national road Cikande Rangkasbitung Cheating car parking caused losses. The work carried out by companies like big trucks interferes with the activity of sects. The surrounding community often complains that trucks are parked wildly on the street shoulder. Who will apply for registration as the owner of the land that has been placed on the land? How do you arrange a parking lot? The research carried out in this study is law enforcement and criminal liability. The method used in this research is a normative jurisprudential method with a legislative approach invitation plus field research as a data support. The specification of the research used in this study is a case study and the data source used is a secondary data source in which it is divided into three parts namely primary, secondary, and tertiary legal materials with library study data collection techniques. Based on this research obtained results that in enforcing the law the police of the Republic of Indonesia use preventive and repressive efforts and the factors that affect the enforcement of the Law i.e., law enforcer factors, means and facilities, society and cultural factors and the responsibility of the parkers wild The Law No. 22 of 2009 on Traffic and Road Transport in this section of liability in wild parking is only punishable with fines and bail to truck drivers who park wild on the road Cikande - Rangkasbitung. The researchers concluded that the efforts made by law enforcement agencies were preventive, repressive and criminal liability of truck drivers who parked wildly on the shoulder of Cikande – Rangkasbitung road is a criminal fine and bail. The suggestion for this study is that law enforcement agencies should patrol more frequently and criminal liability not only for truck drivers but for companies.

| Additional Information: | Salah satu pelanggaran lalu lintas yang sering dijumpai di dalam Masyarakat dan menjadi salah satu faktor laju kendaraan menurun adalah parkir liar yang sering dijumpai di bahu-bahu jalan, kendaraan besar yang parkir secara liar di bahu-bahu jalanan kota maupun berkembang, fenomena ini terjadi dijalan nasional Cikande Rangkasbitung Truk parkir liar menyebabkan kerugian. Padatnya aktifitas industri jalan Cikande – Rangkasbitung menyebabkan kendaraan oprasional dari perusahaan seperti truk - truk besar mengganggu akifitas masyarakat sektar. Masyarakat sekitar sering mengeluhkan adanya truk – truk yang parkir liar di bahu jalan. Identifikasi masalah pada penelitian ini yaitu yang pertama, bagaimana penegakan hukum terhadap pengendara truk sebagai pelaku tindak pidana parkir liar dan pertangungjawaban pidana supir truk yang parkir liar? Kedua, Bagaimana pertanggungjawaban pidana supir truk parkir liar? Teori yang digunakan dalam penelitian ini yaitu penegakan hukum dan pertanggungawaban pidana. Metode yang digunakan dalam penelitian ini yaitu metode yuridis normatif dengan pendekatan perundang – undangan ditambah penelitian di lapangan sebagai pendukung data. Berdasarkan penelitian ini diperoleh hasil bahwa dalam menegakan hukum Kepolisian Republik Indonesia menggunakan Upaya Preventif dan Upaya Represif dan faktor-faktor yang mempengaruhi penegakan hukum yaitu, penegak hukum, sarana dan prasarana, Masyarakat dan faktor kebudayaan dan pertanggungjawaban pelaku parkir liar Undang-Undang Nomor 22 Tahun 2009 Tentang Lalu Lintas Dan Angkutan Jalan dalam pasal ini pertangungjawaban dalam liar hanya dikenakan pidana denda dan tilang kepada supir truk yang parkir liar di jalan Cikande-Rangkasbitung. Kesimpulan peneliti adalah upaya yang dilakukan aparat penegak hukum adalah preventif, represif dan pertanggung jawaban pidana supir truk yang parkir liar di bahu jalan Cikande – Rangkasbitung adalah pidana denda dan tilang. Saran pada penelitian ini adalah aparat penegak hukum agar lebih sering patroli dan pertanggungjawaban pidana tidak hanya untuk supir truk melainkan pada perusahaan | |||||||||
