Abstract
An important aspect of criminal law that seems to receive less attention is the part concerning sentencing as the implementation of court decisions. The implementation of court decisions needs to be monitored and observed, hence the establishment of Supervising and Observing Judges as stipulated in Article 280 of Law No. 8 of 1981 concerning the Criminal Procedure Code (KUHAP) to carry out supervision and observation for the guidance of inmates. This research aims to delve deeper into the role of Supervising and Observing Judges in the guidance of inmates at Class II A Correctional Facility in Serang, particularly within the context of the provisions of Article 280 KUHAP. The problems identified in this research are, Firstly, how do Supervising and Observing Judges play a role in the supervision and observation of inmate guidance as a component of law enforcement based on Article 280 KUHAP? Secondly, what are the obstacles in the execution of the duties of Supervising and Observing Judges in supervising and observing the guidance of inmates at Class II A Correctional Facility in Serang based on Article 280 KUHAP? The theories used in this research are law enforcement and legal effectiveness. The method used in this research is a normative juridical method with a legislative approach. Based on this research, it was found that in the execution of the duties of Supervising and Observing Judges at Class II A Correctional Facility in Serang, several obstacles related to legal factors, law enforcement, facilities, community, culture, and legal effectiveness were encountered. The conclusion is that the execution of the duties of Supervising and Observing Judges has not been optimal, as they lack access to sufficient information to formulate specific methods or techniques for the guidance of particular inmates at Class II A Correctional Facility in Serang, and there is no specific legislation regulating the execution of the duties of Supervising and Observing Judges. The research suggests that law enforcement officers should always be meticulous and assertive in carrying out their duties, and that clear regulations should be established.

| Additional Information: | Suatu bagian penting dari hukum pidana yang tampaknya masih kurang mendapat perhatian adalah bagian mengenai pemidanaan sebagai pelaksanaan dari putusan pengadilan. Pelaksanaan putusan pengadilan perlu diawasi dan diamati sehingga lahirnya Hakim Pengawas dan Pengamat dalam Pasal 280 Undang-Undang Nomor 8 Tahun 1981 tentang Kitab Undang-Undang Hukum Acara Pidana (KUHAP) untuk melaksanakan pengawasan dan pengamatan bagi pembinaan warga binaan. Penelitian ini bertujuan untuk menggali lebih dalam peranan Hakim Pengawas dan Pengamat dalam pembinaan warga binaan di Lembaga Pemasyarakatan Kelas II A Serang, khususnya dalam konteks ketentuan Pasal 280 KUHAP. Identifikasi masalah pada penelitian ini yaitu yang Pertama, bagaimana peran Hakim Pengawas dan Pengamat dalam pengawasan dan pengamatan terhadap pembinaan warga binaan sebagai salah satu komponen penegakan hukum berdasarkan Pasal 280 KUHAP? Kedua, bagaimana kendala pelaksanaan tugas Hakim Pengawas dan Pengamat dalam pengawasan dan pengamatan terhadap pembinaan warga binaan Lembaga Pemasyarakatan Kelas II A Serang berdasarkan Pasal 280 KUHAP? Teori yang digunakan dalam penelitian ini yaitu penegakan hukum dan efektivitas hukum. Metode yang digunakan dalam penelitian ini yaitu metode yuridis normatif dengan pendekatan perundang-undangan. Berdasarkan penelitian ini diperoleh hasil bahwa dalam pelaksanaan tugas Hakim Pengawas dan Pengamat di Lembaga Pemasyarakatan Kelas II A Serang masih dijumpai beberapa kendala yang berkaitan dengan faktor hukum, penegakan hukum, sarana atau fasilitas, masyarakat, dan kebudayaan serta efektivitas hukum. Kesimpulan bahwa pelaksanaan tugas Hakim Pengawas dan Pengamat belum berjalan maksimal dimana Hakim Pengawas dan Pengamat kurang mendapat keterbukaan informasi untuk merumuskan cara atau teknis pembinaan warga binaan tertentu di Lembaga Pemasyarakatan Kelas II A Serang, serta belum ada peraturan perundang-undangan yang secara khusus mengatur tentang pelaksanaan tugas Hakim Pengawas dan Pengamat. Saran peneliti, yaitu aparat penegak hukum senantiasa cermat dan tegas dalam mengemban tugas, serta dibuatnya peraturan perundang-undangan yang jelas. | |||||||||
