Abstract
Viewed from the perspective of the need for labor, Daily Workers will be beneficial because they assist leaders in government agencies in handling tasks. The position of Daily Workers in the order of the Tangerang City Government as supporters of the government's operations. The recruitment of Daily Workers in the government is a complex issue that considers government needs, workers rights, and societal demands. The identification of the problems is as follows, first, How is the authority of the Human Resources and Development Agency in the recruitment of Daily Workers based on the Regulation of the Mayor of Tangerang Number 75 of 2020 concerning Daily Workers in the Environment of the Tangerang City Regional Government, and How is the responsibility of the Tangerang City Human Resources and Development Agency towards the rights of Daily Workers. The theories used are the Authority Theory and Legal Protection Theory. The research method is empirical juridical. The research specification is descriptive-analytical. The data sources are primary data supported by secondary data. Data collection techniques include interviews and documents related to the research. Data are obtained and analyzed descriptively using a qualitative approach. The research results show that the Personnel Agency has the authority in the recruitment and placement of Daily Freelancers according to the needs of the agency. Additionally, the Personnel and Human Resource Development Agency is responsible for the rights of Daily Freelancers, including the creation and termination of work contracts in accordance with applicable regulations. In conclusion, the recruitment process for Daily Freelancers implemented by the Tangerang City Government consists of six stages, and BKPSDM is responsible for fulfilling the rights of the Daily Freelancers. It is recommended that the Personnel and Human Resource Development Agency ensures that information regarding Daily Freelancer vacancies is easily accessible to the public, and that it provides an effective grievance mechanism for Daily Freelancers who feel their rights have been violated.

Kedudukan Tenaga Harian Lepas dalam tatanan Pemerintah Kota Tangerang sebagai penunjang jalannya roda pemerintahan. Penerimaan Tenaga Harian Lepas dalam pemerintahan adalah masalah kompleks yang mempertimbangkan kebutuhan pemerintah, hak pekerja, dan tuntutan masyarakat. Identifikasi masalahnya sebagai berikut, yang pertama Bagaimana kewenangan Badan Kepegawaian dan Pengembangan Sumber Daya Manusia Dalam Penerimaan Tenaga Harian Lepas Berdasarkan Peraturan Walikota Tangerang Nomor 75 Tahun 2020 Tentang Tenaga Harian Lepas Di Lingkungan Pemerintah Daerah Kota Tangerang dan Bagaimana tanggung jawab Badan Kepegawaian dan Pengembangan Sumber Daya Manusia Kota Tangerang terhadap hak-hak Tenaga Harian Lepas. Teori yang digunakan yaitu Teori Kewenangan dan Teori Perlindungan Hukum. Metode Penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analitis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah wawancara dan dokumen yang terkait dengan penelitian. Data diperoleh dan dianalisis secara deskriptif dengan metode pendekatan kualitatif. Hasil penelitian, Badan Kepegawaian memiliki wewenang dalam penerimaan dan penempatan Tenaga Harian Lepas sesuai dengan kebutuhan instansi. Selain itu, Badan Kepegawaian dan Pengembangan Sumber Daya Manusia bertanggung jawab pada hak-hak Tenaga Harian Lepas yaitu terkait kontrak kerja Tenaga Harian Lepas, termasuk pembuatan dan pemutusan kontrak sesuai dengan peraturan yang berlaku. Kesimpulan, dalam penerimaan Tenaga Harian Lepas, proses rekrutmen yang diterapkan oleh Pemerintah Kota Tangerang terbagi atas 6 (enam) tahapan dan BKPSDM memiliki tanggung jawab untuk memenuhi hak Tenaga Harian Lepas tersebut. Saran, Badan Kepegawaian dan Pengembangan Sumber Daya Manusia sebaiknya harus memastikan bahwa informasi terkait lowongan Tenaga Harian Lepas mudah diakses oleh masyarakat dan Badan Kepegawaian dan Pengembangan Sumber Daya Manusia Badan Kepegawaian dan Pengembangan Sumber Daya Manusia perlu menyediakan mekanisme pengaduan yang efektif bagi Tenaga Harian Lepas yang merasa hak-hak mereka dilanggar. | |||||||||
