Abstract

The petrochemical industry and the steel industry produce the most hazardous and toxic waste (B3) which has the potential to pollute the surrounding environment. Based on Article 493 paragraph (3) of Government Regulation Number 22 of 2021 concerning the Implementation of Environmental Protection and Management, the government must supervise the compliance of the person in charge of the business. The problem identification in this thesis is how the implementation of the authority of the Environmental Service on the supervision of industrial B3 waste management in Ciwandan District and what are the obstacles in the implementation of supervisory authority experienced by the Environmental Service on industrial B3 waste management in Ciwandan District. The research method used is empirical juridical method, with analytical descriptive research specifications. The data used are primary legal materials, secondary legal materials, and tertiary legal materials supported by primary data in the form of interviews with the Cilegon City Environmental Service which are analyzed descriptively qualitatively. The results of the study found that first, the authority of the Cilegon City Environmental Service to supervise the management of industrial B3 waste in Ciwandan District is a delegated authority with a form of repressive supervision and is carried out by direct supervision by checking directly to the waste treatment site, checking ownership of environmental documents, and checking the B3 waste management installation. Second, there are three obstacles experienced by the Cilegon City Environmental Agency in carrying out repressive supervision, namely, limited human resources, irregular scheduling of activities, and limited authority owned by the environmental agency. Based on the research conducted, it can be concluded that routine supervision of B3 waste management carried out by the Cilegon City Environmental Service is important to prevent pollution and as an effort to preserve the environment. The advice that can be given is that the Environmental Service must play a more active role in supervising industrial B3 waste in terms of obedience to the person in charge of the business in managing B3 waste generated by the industry.

Additional Information:	Industri petrokimia dan industri baja yang paling banyak menghasikan limbah Bahan Berbahaya dan Beracun (B3) yang berpotensi mencemari lingkungan sekitar. Berdasarkan Pasal 493 ayat (3) Peraturan Pemerintah Nomor 22 Tahun 2021 tentang Penyeenggaraan Perlindungan dan Pengelolaan Lingkungan Hidup pemerintah harus melakukan pengawasan terhadap ketaatan penanggung jawab usaha. Identifikasi masalah dalam skripsi ini yaitu bagaimana pelaksanaan kewenangan Dinas Lingkungan Hidup terhadap pengawasan pengelolaanlimbah B3 industri di Kecamatan Ciwandan dan apa saja hambatan dalam pelaksanaan kewenangan pengawasan yang dialami Dinas Lingkungan Hidup terhadap pengelolaanlimbah B3 industri di Kecamatan Ciwandan. Metode penelitian yang digunakan adalah metode yuridis empiris, dengan spesifikasi penelitian deskriptif analitis. Data yang digunakan yaitu bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang ditunjang dengan data primer berupa wawancara dengan pihak Dinas Lingkungan Hidup Kota Cilegon yang dianalisis secara deskriptif kualitatif. Hasil penelitian didapatkan bahwa pertama, kewenangan Dinas Lingkungan Hidup Kota Cilegon terhadap pengawasan pengelolaan limbah B3 Industri yang ada di Kecamatan Ciwandan merupakan kewenangan delegasi dengan bentuk pengawasan represif dan dilakukan secara pengawasan langsung dengan memeriksa langsung ke tempat pengolahan limbah, memeriksa kepemilikan dokumen lingkungan, dan pemeriksaan instalasi pengelolaan limbah B3. Kedua, terdapat tiga hambatan yang di alami oleh Dinas Lingkungan Hidup Kota Cilegon dalam melakukan pengawasan represif yakni, keterbatasan sumber daya manusia, penjadwalan kegiatan belum teratur, dan keterbasan kewenangan yang dimiliki dinas lingkungan hidup. Berdasarkan penelitian yang dilakukan, didapatkan kesimpulan bahwa pengawasan rutin terhadap pengelolaanlimbah B3 yang dilakukan Dinas Lingkungan Hidup Kota Cilegon penting untuk mencegah pencemaran serta sebagai upaya pelestarian lingkungan hidup. Adapun saran yang dapat diberikan adalah Dinas Lingkungan Hidup harus berperan lebih aktif dalam melakukan pengawasan terhadaplimbah B3 industri dalam hal ketaatan penanggung jawab usaha dalam melakukan pengelolaan limbah B3 yang dihasilkan oleh industrinya.
