Abstract

The economic crisis, which has not yet recovered, has hampered economic growth and increased living standards of the Indonesian people. All of this causes the foundation of the Indonesian economy so that it is very vulnerable to various fluctuations. One of the tools used as a benchmark for conducting business in Indonesia is the establishment of a business entity as a starting point for starting a business in Indonesia. In general, whether or not a business entity is regulated in a country affects the ease of doing business (EoDB) of that country. The enactment of the company registration mark is to regulate and record how many companies there are in Indonesia. Mandatory Company Registration is very important, because the company register is a list of official records that can be used by parties who need it. One of the main goals is to provide protection to companies that run honestly and openly or in good faith. The problem that is often encountered in dealing with company signs electronically is that many people do not understand how to use the system electronically and the licensing server is often disturbed. Several problems in the implementation of OSS business licensing, first, PP No. 24/2018 does not regulate the transition period for its implementation. PP No. 24/2018 is valid at the time of its promulgation, which is June 21 2018, while there are still permits regulated in the PP Annex that cannot be served through the OSS system. Director of BKPM Facilities Services, Endang Supriyadi, stated that BKPM only found out on June 28, 2018 that the PP was immediately effective without a transition period. The method used in this research is by empirical juridical approach the empirical juridical approach or legal sociology is an approach that looks at a legal situation that resed in society. The analysis carried out in this research is a qualitative method.

Additional Information:	Krisis ekonomi yang hingga saat ini belum pulih mengakibatkan terhambatnya pertumbuhan ekonomi dan merosotnya taraf hidup masyarakat Indonesia. Kesemuanya ini menyebabkan kerapuhan landasan perekonomian Indonesia sehingga sangat rentan terhadap berbagai gejolak. Salah satu sarana yang dijadikan tolok ukur penyelenggaraan bisnis di Indonesia adalah melalui pembentukan badan usaha sebagai langkah awal untuk memulai bisnis di Indonesia. Secara umum, baik tidaknya pengaturan badan usaha di suatu negara berpengaruh pada ease of doing business (EoDB) negara tersebut. Diberlakukannya tanda daftar perusahaan adalah untuk menertibkan dan mendata berapa banyak perusahaan yang ada di Indonesia. Wajib Daftar Perusahaan merupakan hal yang sangat penting, karena daftar perusahaan merupakan daftar catatan resmi yang dapat dipergunakan oleh pihak-pihak yang memerlukan. Salah satu tujuan utama daftar perusahaan adalah untuk memberikan perlindungan kepada perusahaan-perusahaan yang menjalankan usahanya secara jujur dan terbuka atau dengan itikad baik. Permasalahan yang sering ditemui dalam mengurus tanda daftar perusahaan secara elektronik adalah banyaknya masyarakat yang belum mengerti bagaimana menggunakan sistem secara elektronik serta server perizinan yang sering mengalami gangguan. Beberapa permasalahan dalam pelaksanaan perizinan berusaha OSS, pertama, PP No. 24/2018 tidak mengatur masa transisi pemberlakuannya. PP No. 24/2018 langsung berlaku pada saat diundangkan, yaitu 21 Juni 2018, sedangkan masih ada perizinan yang diatur dalam Lampiran PP yang belum dapat dilayani melalui sistem OSS. Direktur Pelayanan Fasilitas BKPM Endang Supriyadi menyatakan, BKPM baru mengetahui pada 28 Juni 2018 bahwa PP langsung berlaku tanpa masa transisi. Metode yang digunakan dalam penelitian ini yaitu dengan metode pendekatan yuridis empiris Pendekatan yuridis empiris atau sosiologi hukum adalah pendekatan yang melihat suatu keadaan hukum yang berada di masyarakat. Analisis yang dilakukan dalam penelitian ini merupakan metode kualitatif.
