Abstract
The authority of the Village Head as the administrator of the village government of course speaks about legal actions carried out by the Village Head, in this case it is of course related to the power in making governing decisions by delegating responsibility to other parties in appointing or dismissing village officials, in legal terminology the authority of state officials and /or state administration is divided into 3 sources of authority, namely: attribution, delegation and mandate. In its implementation, it is possible for the Village Government for the Village Head not to carry out his duties in accordance with the work period limit, this is due to several factors as explained in Article 54 Paragraph (1) of Government Regulation Number 43 of 2014. The problem identification in this research is, What is the authority of the Secretary? village regarding the vacancy in the position of village head in Margagiri village based on Pandeglang Regency regional regulation Number 1 of 2015 concerning procedures for nominating, selecting, inaugurating and dismissing village heads which refers to article 54? and What are the factors inhibiting the village secretary's consideration of the vacancy in the position of village head in Margagiri village? The theory used in this research uses the Authority Theory and Village Government Theory. This research uses empirical juridical methods with analytical descriptive research specifications. The data used in this research is secondary data supported by primary data in the form of interviews with Margagiri village office staff which were analyzed descriptively qualitatively. The research results show that there are several things that can cause a village head to quit before his term of office, one of which is death. So in this case there is a vacancy in a village official's position, so the duties of the vacant village official are carried out by an executor who has a position from the same element. The inhibiting factor is that there are complaints from various groups regarding the appointment of village secretaries to fill vacancies, especially from other village officials. Every time a village election is held, there is concern because if the village head is replaced, other village officials will be reshuffled and changed. So it is necessary to hold outreach with the sub-district head and the Margagiri village government so that there are no concerns about services, especially for the community.

Additional Information: | Kewenangan Kepala Desa selaku penyelenggara pemerintahan desa tentunya berbicara tentang perbuatan hukum yang dilakukan Kepala Desa dalam hal ini tentunya berkaitan dengan kekuasaan dalam membuat keputusan memerintah secara melimpahkan tanggung jawab kepada pihak lain dalam melakukan pengangkatan atau pemberhentian perangkat desa, dalam terminologi ilmu hukum kewenangan penjabat negara dan/atau administrasi negara terbagi atas 3 sumber kewenangan yakni: atribusi, delegasi, dan mandat. Dalam pelaksanaannya, Pemerintah Desa dimungkinkan Kepala Desa tidakmelaksanakan tugasnya sesuai dengan batas masa kerja, hal ini dikarenakan beberapa faktor seperti yang dijelaskan pada Pasal 54 Ayat (1) Peraturan Pemerintah Nomor 43 Tahun 2014. Adapun identifikasi masalah dalam penelitian ini adalah, Bagaimana kewenangan Sekretaris desa atas kekosongan jabatan kepala desa di desa margagiri berdasarkan peraturan daerah Kabupaten Pandeglang Nomor 1 tahun 2015 tentang tata cara pencalonan, pemilihan, pelantikan dan pemberhentian kepala desa yang mengacu pada pasal 54? dan Apa faktor penghambat pertimbangan sekretaris desa atas kekosongan jabatan kepala desa di desa margagiri?. Teori yang digunakan dalam penelitian ini menggunakan Teori Kewenangan dan Teori Pemerintahan desa. Penelitian ini menggunakan metode yuridis empiris dengan spesifikasi penelitian deskriptif analitis. Data yang digunakan dalam penelitian ini yaitu data sekunder yang ditunjang dengan data primer berupa wawancara dengan staff Kantor desa Margagiri yang dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukan bahwa ada beberapa hal yang dapat menyebabkan kepala desa berhenti sebelum masa jabatannya salah satunya karena meninggal dunia. Sehingga dalam hal ini terjadi kekosongan jabatan perangkat desa, maka tugas perangkat desa yang kosong dilaksanakan oleh pelaksana tugas yang memiliki posisi jabatan dari unsur sama. Yang menjadi faktor penghambat tejadi keluhan dari berbagai kelangan mengenai pengangkatan sekretaris desa dalam mengisi kekosongan jabatan, terutama dari perangkat desa lainnya, setiap kali akan dilaksanakannya pilkades terjadi kekhawatiran karena jika kepala desanya ganti maka perangkat desa lainnya akan terjadinya perombakan dan perubahan. Sehingga perlu diadakan sosialisasi dengan pihak camat dan pemerintah desa margagiri agar tidak terjadinya kekhawatiran terhadap pelayanan khususnya untuk masyarakat. | |||||||||
