Abstract
Gacha is a type of game model by purchasing virtual currency in the game to buy virtual goods or items, which persuades game players to spend real money so that players receive random virtual goods or items. Game players who use the gacha system often experience losses because the chance of getting rare items is very small, which often triggers players to make repeated purchases. The problem that will be discussed in this research is how the legal protection and responsibility of business actors regarding the implementation of the Gacha system in online games is reviewed from Law No. 8 of 1999 concerning Consumer Protection. This research uses the theory of consumer protection and business actor responsibility. This research uses normative juridical methods. This type of research uses qualitative descriptive research. The data sources used are primary data sources and secondary data sources. The research results show that legal protection for game players who make purchases using the online game Mobile Legends BangBang has not been fully implemented in accordance with Article 4 letter b of Law no. 8 of 1999 concerning Consumer Protection regarding consumer rights. Responsibilities given by PT. Moontom as a business actor regarding losses to game players who use the gacha system has not been implemented optimally in accordance with Article 19 of Law No. 8 of 1999 concerning Consumer Protection regarding the responsibilities of business actors. Suggestions to the Government to be more assertive in making laws and regulations to protect consumer rights

Additional Information: | Gacha adalah model jenis permainan dengan cara membeli mata uang virtual dalam game untuk membeli barang atau item virtual, yang membujuk para pemain game untuk mengeluarkan uang nyata agar pemain menerima barang atau item virtual secara acak. Pemain game yang melakukan sistem gacha sering mengalami kerugian karena peluang mendapatkan item langka sangat kecil, sehingga sering memicu pemain untuk melakukan pembelian berulang kali. Permasalahan yang akan dibahas pada penelitian ini adalah bagaimana perlindungan hukum dan tanggung jawab pelaku usaha atas pemberlakuan sistem Gacha pada game online ditinjau dari Undang-Undang No.8 Tahun 1999 Tentang Perlindungan Konusmen. Penelitian ini menggunakan teori perlindungan konsumen dan tanggung jawab pelaku usaha. Penelitian ini menggunakan metode yuridis normatif. Jenis penelitian ini menggunakan penelitian deskriptif kualitatif. Sumber data yang digunakan yaitu sumber data primer dan sumber data sekunder. Hasil penelitian menunjukan bahwa perlindungan hukum terhadap pemain game yang melakukan pembelian dengan sistem pada game online Mobile Legends Bang-Bang belum dilakukan secara penuh sesuai Pasal 4 huruf b Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen terkait hak-hak konsumen. Tanggung jawab yang diberikan oleh PT. Moontom sebagai pelaku usaha terhadap kerugian pemain game yang melakukan sistem gacha belum dilakukan secara maksimal sesuai Pasal 19 Undang-Undang No.8 Tahun 1999 tentang Perlindungan Konsumen terkait tanggung jawab pelaku usaha. Saran kepada Pemerintah agar lebih tegas dalam membuat peraturan perundang undangan untuk melindungi hak-hak konsumen. | |||||||||
