Abstract

This article aims to explore the dynamics related to the experiences of construction and meaning of gender justice for women victims of sexual violence who are ignored by the state when reporting. The issue of justice for victims of sexual violence is a crucial issue because women often receive discriminatory treatment which actually gives rise to Victim Blaming. Gender & Feminism Theory and Gender Justice are the main aspects in dissecting this research problem. The research method used is qualitative with a phenomenological approach from Creswell's thinking which focuses on the meaning of "Gender Justice" based on the experiences of key informants which produces many differences in providing views based on life experience. Furthermore, the results of research related to the construction of gender justice experiences for women victims of sexual violence produce the following conclusions: First, there is a lack of empathy and adequate training within law enforcement officials regarding the sensitivity of sexual violence cases. Second, stigma and intimidation by law enforcement officers, namely minimal legal protection for victims. Third, the bureaucracy is complicated and unresponsive, namely the existing legal system is ineffective in providing gender justice and often ignores the needs and rights of victims of sexual violence. Furthermore, in understanding the context of gender justice in general for women victims of sexual violence, women and men must be treated fairly and equally in various domains of life without any differences in behavior.

Additional Information:	Tulisan ini bertujuan untuk mengeksplorasi permasalahan terkait konstruksi pengalaman dan pemaknaan keadilan gender dari para perempuan korban kekerasan seksual yang diabaikan oleh negara ketika memberikan pelaporan. Persoalan keadilan terhadap korban kekerasan seksual merupakan isu krusial karena perempuan kerap kali mendapatkan perlakuan diskriminatif yang justru menimbulkan Victim Blaming. Teori Gender & Feminisme dan Keadilan Gender menjadi aspek utama dalam membedah permasalahan penelitian ini. Metode penelitian yang digunakan yaitu kualitatif dengan pendekatan fenomenologi dari pemikiran Creswell memfokuskan pemaknaan terhadap “Keadilan Gender” berdasarkan pengalaman dari key informant yang menghasilkan banyak perbedaan dalam memberikan pandangan berdasarkan pengalaman hidup. Selanjutnya, hasil penelitian terkait konstruksi pengalaman keadilan gender bagi para perempuan korban kekerasan seksual menghasilkan konklusi: Pertama, kurangnya empati dan pelatihan yang memadai di lingkungan aparat penegak hukum mengenai sensitivitas kasus kekerasan seksual. Kedua, stigma dan intimidasi oleh aparat penegak hukum yaitu minimnya perlindungan hukum bagi korban. Ketiga, birokrasi yang berbelit dan tidak responsif yaitu sistem hukum yang ada tidak efektif dalam memberikan keadilan gender dan sering kali mengabaikan kebutuhan serta hak-hak korban kekerasan seksual. Selanjutnya, dalam memahami konteks keadilan gender secara general bagi perempuan korban kekerasan seksual, bahwasanya perempuan dan laki-laki harus diperlakukan adil dan setara dalam berbagai ranah kehidupan tanpa adanya perbedaan perilaku.
