Abstract
Brokers In Serang Regency, it still thrives every year. For example, at PT Nikomas Gemilang brokering in this company has become an open secret, all levels of society already know that the activities carried out by brokers are bribery activities, the amount of money requested by brokers is around Rp. 15,000,000. - Rp. 40,000,000, this makes it difficult for people to find work. Brokers can be charged under Law No. 11 of 1980 concerning the Crime of Bribery. In practice, enforcement of this law has not been carried out optimally. In this thesis the researcher took two problem identifications. How is the law enforced against bribery practices carried out by brokers in labor recruitment at PT Nikomas Gemilang? What are the police's efforts to tackle the practice of bribery by brokers in labor recruitment? The theories used are law enforcement theory and crime prevention theory. The method used by researchers in writing this thesis is Sociological Juridical, with research specifications namely an interpretive approach. From the research results, it is known that various factors cause the police to not enforce law optimally in eradicating brokering at PT Nikomas Gemilang, namely community factors and law enforcement officers. The Serang Regency Police have not enforced the law optimally, due to the fact that there has been no action or sanctions for brokers who commit acts of bribery, and efforts to overcome crimes such as penal and non-penal actions have also not been carried out optimally, because the Serang Regency Police have not carried out good prevention. in the form of penal or non-penal for the bribery case itself. As a response to this situation, the police need to be serious about handling this case, because the aim of law enforcement is to create a sense of justice, legal certainty and benefit in society

| Additional Information: | Calo di Kabupaten Serang masih bekembang subur di setiap tahunnya. Contohnya pada PT Nikomas Gemilang percaloan di perusahaan tersebut sudah menjadi rahasia umum, semua lapisan masyarakat sudah mengetahui kegiatan yang dilakukan oleh Calo merupakan kegiatan suap-menyuap, jumlah uang yang diminta Calo berkisar Rp. 15.000.000. - Rp. 40.000.000, hal ini mempersulit masyarakat untuk mecari pekerjaan. Calo dapat dijerat dengan UU No. 11 Tahun 1980 tentang Tindak Pidana Suap. Dalam praktiknya, penegakan undang-undang tersebut belum maksimal dilakukan. Pada skripsi ini peneliti mengambil dua identifikasi masalah. Bagaimana penegakan hukum terhadap praktik suap yang dilakukan Calo dalam rekrutmen tenaga kerja di PT Nikomas Gemilang? Bagaimana upaya kepolisian dalam menanggulangi adanya praktik suap yang dilakukan calo dalam rekrutmen tenaga kerja? Teori yang digunakan teori penegakan hukum dan teori penanggulangan kejahatan. Metode yang digunakan Peneliti di dalam penulisan skripsi ini ialah Yuridis Sosiologis, dengan spesifikasi penelitian yaitu pendekatan interpretatif. Dari hasil penelitian diketahui berbagai faktor penyebab belum optimalnya penegakan hukum oleh kepolisian dalam membrantas percaloan di PT Nikomas Gemilang yaitu faktor masyarakat dan aparat penegak hukumnya. Polres Kabupten Serang belum melakukan penegakan hukum secara optimal, karena faktanya belum adanya tindakan atau sanksi bagi Calo yang melakukan tindakan suap, dan dalam upaya penanggulangan kejahatan seperti tindakan penal dan non-penal juga belum dilakukan secara optimal, karena Polres Kabupten Serang tidak melakukan pencegahan baik berupa penal maupun non penal untuk kasus suapnya sendiri. Sebagai respon dari keadaan tersebut, perlu dilakukan keseriusan kepolisian untuk menangani kasus ini, karena tujuan dari penegakan hukum ialah untuk mewujudkan adanya rasa keadilan, kepastian hukum, dan kemanfaatan dalam masyarakat. | |||||||||
