Abstract

The existence of the LGBT community in Indonesia has not received recognition and even tends to face discrimination, both from the government and society. The LGBT community is a group that has a high risk of contracting and transmitting HIV to other groups. The Surabaya City Government, through Surabaya Mayor Regulation Number 29 of 2015 concerning Implementation of Surabaya City Regional Regulation Number 4 of 2013 concerning HIV and AIDS Management, is trying to overcome the high level of HIV and AIDS. These regulations consist of steps to prevent and transmit HIV, namely health promotion, prevention of HIV transmission, diagnostic examination, treatment, care, support and rehabilitation. In its implementation, the Surabaya City Government networks with related organizations to find out the situation and field conditions faced by these organizations. This research uses inclusion theory by Naila Kabeer to interpret LGBT health rights policies in the city of Surabaya. This theory has four indicators, namely justice, recognition, self-determination, and solidarity. The method used is a qualitative method with an instrumental case study approach. The results of this research show that the implementation of Surabaya Mayor Regulation Number 29 of 2015 has not been fully inclusive. However, there are three internal community problems that influence this, namely stigma, education and self-awareness that arise from internal and external LGBT communities in the city of Surabaya.

Additional Information:	Keberadaan kelompok LGBT di Indonesia belum mendapatkan pengakuan bahkan cenderung memperoleh diskriminasi, baik dari pemerintah maupun masyarakat. Kelompok LGBT merupakan salah satu kelompok yang memiliki risiko tinggi tertular dan menularkan HIV terhadap kelompok lainnya. Pemerintah Kota Surabaya melalui Peraturan Walikota Surabaya Nomor 29 Tahun 2015 tentang Pelaksanaan Peraturan Daerah Kota Surabaya Nomor 4 tahun 2013 tentang Penanggulangan HIV dan AIDS berupaya untuk menanggulangi tingginya HIV dan AIDS. Peraturan tersebut terdiri dari langkah-langkah pencegahan dan penularan HIV, yakni promosi kesehatan, pencegahan penularan HIV, pemeriksaan diagnosis, Pengobatan, perawatan, dukungan, dan rehabilitasi. Dalam pelaksanaannya Pemerintah Kota Surabaya berjejaring dengan organisasi terkait untuk mengetahui situasi dan kondisi lapangan yang dihadapi oleh organisasi tersebut. Penelitian ini menggunakan teori inklusi oleh Naila Kabeer memaknai kebijakan hak kesehatan LGBT di Kota Surabaya. Teori ini memiliki empat indikator, yaitu keadilan, pengakuan, penentuan nasib, dan solidaritas. Metode yang digunakan adalah metode kualitatif dengan pendekatan instrumental case study. Hasil penelitian ini menunjukkan bahwa dalam implementasi Peraturan Walikota Surabaya Nomor 29 Tahun 2015 belum sepenuhnya menunjukkan inklusi. Namun, terdapat tiga permasalahan internal kelompok yang mempengaruhi hal tersebut, yakni stigma, edukasi, dan kesadaran diri yang hadir dari internal maupun eksternal kelompok LGBT di Kota Surabaya.
