Abstract
Health is something that has important role in human life. In addition to body health, oral health is also one of the things that needs attention. Denturist are traditional health workers who uses his/her skill. A denturist is one of the alternatives to traditional health services related to teeth and mouth. Denturist are easy to find and relatively inexpensive. However, denturists might open dental practices outside of their authority. Denturist who practice outside thei authority are certainly violating the rules because denturist are only allowed to make removable dentures. Practice that violate this rule are dangerous because they can cause harm in the form of illness or even death. Accordingly, researchers are interested in knowing how denturist work is based on Indonesian positive law and also how criminal liability for denturists who practicing dental care outside their authority. The method used is normative juridical. The specification of this research is descriptive analytical. Data collection techniques using literature study. The results of this study concluded that dentists can only do their work after having an official license to make removable dentures. Rules that governing denturist are considered inadequate. Second, that the criminal liability of dentists based on Undang-undang Nomor 17 Tahun 2023 is not running optimally.

| Additional Information: | Kesehatan merupakan hal yang berperan penting dalam kehidupan manusia. Selain kesehatan tubuh, kesehatan gigi dan mulut juga salah satu hal yang perlu diperhatikan. Tukang gigi adalah tenaga kesehatan tradisional yang menggunakan keahlian. Tukang gigi merupakan salah satu alternatif layanan kesehatan tradisional terkait gigi dan mulut. Tukang gigi mudah ditemui dalam kehidupan masyarakat dan biayanya relatif lebih murah. Hal ini tidak menutup kemungkinan tukang gigi membuka praktik perawatan gigi di luar kewenangannya. Tukang gigi yang melakukan praktik di luar kewenangan ini tentu menyalahi aturan karena tukang gigi hanya diperbolehkan untuk membuat gigi tiruan lepas pasang. Praktik yang menyalahi aturan ini berbahaya karena bisa menimbulkan kerugian berupa sakit atau bahkan kematian. Oleh karena itu, peneliti tertarik untuk mengetahui bagaimana pengaturan pekerjaan tukang gigi berdasarkan hukum positif Indonesia dan bagaimana pertanggungjawaban pidana terhadap tukang gigi yang melakukan praktik di luar kewenangan. Metode yang digunakan adalah yuridis normatif. Spesifikasi penelitian ini adalah deskriptif analitis. Teknik pengumpulan data menggunakan studi pustaka. Hasil penelitian ini disimpulkan bahwa tukang gigi hanya dapat melakukan pekerjaannya setelah mempunyai izin resmi dengan kewenangan untuk membuat gigi tiruan lepas pasang. Aturan yang mengatur tukang gigi dinilai kurang memadai. Kedua, bahwa pertanggungjawaban pidana tukang gigi berdasarkan Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan belum berjalan secara maksimal. | |||||||||
