Abstract
Article 33 Paragraph (3) of the 1945 Constitution states that: "Earth, water and the natural resources contained therein are controlled by the State and used for the greatest prosperity of the people." Therefore, the government carries out arrangements or controls in order to realize land as a source of people's welfare and to create a more just life, guarantee the sustainability of the Indonesian social and national system and strengthen social harmony. The identification of the problem in this research is what are the criteria for abandoned land based on PP Number 20 of 2021 and how to control abandoned land in the Tanjung Lesung Special Economic Zone by the Pandeglang Regency Land Office based on PP Number 20 of 2021. The theory used is the theory of legal certainty and benefit. . Researchers use empirical juridical methods with analytical descriptive research specifications. Secondary data collection techniques were obtained by conducting a literature study and primary data was obtained from interviews with employees of the Pandeglang Regency Land Office, then the data was analyzed descriptively qualitatively. The results of this research are that in the process of controlling abandoned land, 15 plots of land with Building Use Rights belonging to PT Banten West Java in the Tanjung Lesung Special Economic Zone have met the criteria for land indicated as abandoned in accordance with the criteria set out according to PP Number 20 of 2021, the rights holders do not cultivate and utilize it. The land is in accordance with the applicable laws and regulations because the land is not physically used according to its nature and purpose, namely for tourist attractions, the condition of land use for plantations and rice fields and the land cover in the form of shrubs make the land indicated as abandoned land. The implementation of controlling abandoned land with Building Use Rights status belonging to PT Banten West Java in the Tanjung Lesung Special Economic Zone has been carried out in accordance with the provisions of PP Number 20 of 2021 concerning Controlling Abandoned Areas and Land, which includes (1) inventory of land rights or the basis for control over land which are indicated to be abandoned (2) identify and research land indicated to be abandoned, and (3) provide warnings to rights holders.

| Additional Information: | Pasal 33 Ayat (3) UUD 1945 menyebutkan bahwa: “Bumi, air dan kekayaan alam yang terkandung di dalamnya dikuasai Negara dan dipergunakan untuk sebesar-besarnya kemakmuran rakyat”. Oleh karena itu pemerintah melakukan penataan atau pun penertiban guna mewujudkan tanah sebagai sumber kesejahteraan rakyat dan untuk mewujudkan kehidupan yang lebih berkeadilan, menjamin keberlanjutan sistem kemasyarakatan dan kebangsaan Indonesia serta memperkuat harmoni sosial. Identifikasi masalah dalam penelitian ini adalah apa saja kriteria tanah terlantar berdasarkan PP Nomor 20 Tahun 2021 serta bagaimana pelaksanaan penertiban tanah terlantar di Kawasan Ekonomi Khusus Tanjung Lesung oleh Kantor Pertanahan Kabupaten Pandeglang berdasarkan PP Nomor 20 Tahun 2021. Teori yang digunakan yaitu teori kepastian hukum dan kemanfaatan. Peneliti menggunakan metode yuridis empiris dengan spesifikasi penelitian deskriptif analitis. Teknik pengumpulan data sekunder diperoleh dengan melakukan studi kepustakaan dan data primer diperoleh dari hasil wawancara dengan pegawai Kantor Pertanahan Kabupaten Pandeglang, kemudian data dianalisis secara deskriptif kualitatif. Hasil penelitian ini yaitu pada proses penertiban tanah terlantar 15 bidang tanah Hak Guna Bangunan milik PT Banten West Java di Kawasan Ekonomi Khusus Tanjung Lesung telah memenuhi kriteria tanah terindikasi terlantar sesuai dengan kriteria yang ditetapkan menurut PP Nomor 20 Tahun 2021, pemegang hak tidak mengusahakan dan memanfaatkan tanahnya sesuai dengan Peraturan Perundangan yang berlaku karena secara fisik tidak dimanfaatkan tanahnya sesuai dengan sifat dan peruntukannya yaitu untuk objek wisata, kondisi penggunaan tanah untuk perkebunan dan persawahan serta tutupan lahan berupa semak belukar menjadikan tanah tersebut diindikasikan sebagai tanah yang ditelantarkan. Pelaksanaan penertiban tanah terlantar dengan status Hak Guna Bangunan milik PT Banten West Java di Kawasan Ekonomi Khusus Tanjung Lesung telah dilaksanakan sesuai dengan ketentuan PP Nomor 20 Tahun 2021 Tentang Penertiban Kawasan dan Tanah Terlantar, yaitu meliputi (1) inventarisasi tanah hak atau dasar penguasaan atas tanah yang terindikasi terlantar (2) identifikasi dan penelitian tanah terindikasi terlantar, serta (3) pemberian peringatan terhadap pemegang hak. | |||||||||
