Abstract

In writing this thesis, the author raises legal issues from the formation of the United States Space Force. Where the definition of space is a source of natural resources which in certain cases is limited, especially related to the privileges of the equatorial region. Space is an area that is far above the surface of the earth, where the position of the space should not be any country that owns / positions their country's territory. The formation of the Space Force owned by the country with the nickname Uncle Sam (United States) resulted in a lot of unrest from various parties, both from the state and from legal experts who questioned the legal status of the formation of the space force. Based on this unrest, this paper raises the formulation of the problem; First, How is the regulation of the formation of space armed forces (Space Force) according to the Outer Space Treaty 1967? Second, whether the reasons for Self-Defense can justify the formation of the United States Space Force. This research was conducted using normative juridical research methods and by using literature studies as research material and analyzed with qualitative analysis. The principle of Peacefull Purpose and the theory of state sovereignty are the basic theories that the author uses. Likewise, the principle of Self Defense itself as a reference for the author to find out the truth of the actions of the United States. The result of the research is that the Space Force is legitimate to be formed. This happens because based on the practices of various countries, it means that the principle of peacefull purpose is a non-aggressive action, not a non-military action. This fact is reinforced because there is no concrete explanation regarding the prohibition of the formation of special forces operating in outer space. However, the activities of the Space Force itself can only carry out military activities that are passive in accordance with the meaning of the principle of peaceful purpose. Which is an act of harming other countries in the form of military aggression, and also a prohibition in terms of anticipatory Self-Defense.

Additional Information:	Pada penulisan skripsi ini penulis mengangkat permasalahan hukum dari pembentukan Pasukan Luar Angkasa Amerika Serikat. Yang dimana pengertian dari ruang angkasa adalah sumber kekayaan alam yang dalam hal-hal tertentu bersifat terbatas, khususnya terkait dengan keistimewaan wilayah khatulistiwa. Ruang angkasa merupakan daerah yang berada jauh di atas permukaan bumi, yang dimana posisi dari ruang tersebut tidak boleh adanya satu negara manapun yang memiliki/memposisikan wilayah negara mereka. Pembentukan dari Pasukan Luar Angkasa yang dimiliki negeri dengan julukan Paman Sam (Amerika Serikat) tersebut mengakibatkan timbulnya banyak keresahan dari berbagai pihak, baik dari negara maupun dari para ahli hukum yang mempertanyakan status hukum dari pembentukan pasukan luar angkasa tersebut. Berdasarkan keresahan tersebut, penulisan ini mengangkat rumusan masalah; Pertama, Bagaimana pengaturan tentang pembentukan angkatan bersenjata luar angkasa (Space Force) menurut Outer Space Treaty 1967? Kedua, Apakah alasan bela diri (Self Defence) dapat membenarkan kegiatan pembentukan angkatan bersenjata luar angkasa (Space force) Amerika Serikat?. Penelitian ini dilakukan dengan menggunakan metode penelitiaan yuridis normatif dan dengan menggunakan studi kepustakaan sebagai bahan penelitian dan dianalisa dengan analisa kualitatif. Prinsip Peacefull Purpose dan teori kedaulatan negara menjadi teori dasar yang penulis gunakan. Begitu juga dengan prinsip Self Defence itu sendiri sebagai acuan penulis untuk mencari tahu kebenaran dari tindakan Amerika Serikat. Hasil dari penelitian Pasukan Luar Angkasa/Space Force sah untuk dibentuk. Hal itu terjadi karena berdasarkan praktik dari berbagai negara mengartikan bahwa prinsip peacefull purpose merupakan tindakan yang non-aggresive bukan merupakan tindakan non-military. Fakta tersebut diperkuat karna tidak adanya penjelasan yang konkrit mengenai pelarangan pembentukan pasukan khusus yang beroperasi di luar angkasa. Walau begitu tindakan aktivitas dari Space Force itu sendiri hanya boleh melakukan aktivitas militernya yang bersifar pasif sesuai dengan makna dari prinsip peacefull purpose. Yang dimana merupakan tindakan merugikan negara lain dalam bentuk agresi militer, dan juga pelarangan dalam hal pertahanan diri yang bersifat tindakan antisipatif.
