Abstract
The authority for providing education in outermost regions is regulated by the Minister of Education and Culture Regulation Number 34 of 2012 concerning the criteria for special regions and the provision of special allowances for teachers. According to Article 4, paragraph (1), the proposal of special regions based on these criteria falls under the authority of the Lebak Regency Education Office, acting under the mandate from the local government. The implementation of education in Lebak Regency still faces several issues, including the attitude towards local government policies, the role of supervision, teacher welfare, and infrastructure facilities. These problems hinder the optimization of educational resources in the region. This research identifies issues related to the implementation of authority and the obstacles faced by the Lebak Regency Education Office. The research method used is empirical juridical with a descriptive analytical approach. Primary data were collected through interviews with the head of the curriculum section for elementary schools at the Lebak Regency Education Office and teachers from SDN 1 Lebaksangka. Secondary data were obtained from primary legal materials such as laws, and secondary materials such as books related to the research. Data analysis was conducted using a qualitative approach. The research results indicate that the Lebak Regency Education Office has carried out its authority in accordance with Article 4, paragraph (1), but there are still obstacles in its implementation. These obstacles include differences in perception between the central and local governments regarding the status of Lebak Regency, low teacher welfare, uneven infrastructure, and supervision that is not yet fully optimal. These obstacles disrupt the process of implementing authority by the Lebak Regency Education Office. In conclusion, the exercise of authority by the Department of Education of Lebak Regency complies with the Regulation of the Minister of Education and Culture Number 34 of 2012, but there are still obstacles. Menurut Pasal 4 ayat (1), pengusulan daerah khusus berdasarkan kriteria menjadi kewenangan Dinas Pendidikan Kabupaten Lebak, yang bertindak berdasarkan mandat dari pemerintah daerah. Penyelenggaraan pendidikan di Kabupaten Lebak masih menghadapi beberapa permasalahan, termasuk sikap atas kebijakan pemerintah daerah, peran pengawasan, kesejahteraan guru, dan infrastruktur sarana dan prasarana. Permasalahan ini menghambat optimasi sumber daya pendidikan di wilayah tersebut. Identifikasi masalah dalam penelitian ini adalah terkait pelaksanaan kewenangan dan hambatan yang dihadapi oleh Dinas Pendidikan Kabupaten Lebak. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan deskriptif analitis. Data primer dikumpulkan melalui wawancara dengan kepala seksi kurikulum bidang sekolah dasar Dinas Pendidikan Kabupaten Lebak dan guru SDN 1 Lebaksangka. Data sekunder berasal dari bahan hukum primer seperti undang-undang, serta buku-buku terkait penelitian. Analisis data dilakukan menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa Dinas Pendidikan Kabupaten Lebak telah melaksanakan kewenangannya sesuai dengan pasal 4 ayat (1), tetapi masih terdapat hambatan dalam pelaksanaannya. Hambatan tersebut termasuk perbedaan persepsi antara pemerintah pusat dan daerah mengenai status Kabupaten Lebak, rendahnya kesejahteraan guru, infrastruktur yang tidak merata, dan pengawasan yang belum maksimal. Hambatan-hambatan ini mengganggu proses pelaksanaan kewenangan oleh Dinas Pendidikan Kabupaten Lebak. Kesimpulan dalam penelitian ini adalah pelaksanaan kewenangan oleh Dinas Pendidikan Kabupaten Lebak sesuai dengan Peraturan Menteri Pendidikan dan Kebudayaan Nomor 34 Tahun 2012, namun masih ada hambatan. Saran dalam penelitian ini adalah, memperkuat pengawasan, meningkatkan kesadaran pemerintah daerah, dan mengatasi hambatan tersebut. | |||||||||
