Abstract
The State Civil Apparatus in carrying out government duties has a code of conduct called a code of ethics. The process of implementing the code of ethics is carried out by the DKI Jakarta Provincial Inspectorate as the Code of Ethics Council which regulates the supervision and guidance of state civil servants, one of which is the DKI Jakarta Provincial Transportation Service. The aim of implementing the code of ethics guidelines is to demonstrate the professionalism of state civil servants working in terms of state ethics, organizational ethics and ethics in society. Identify the problem, what is the authority of the Code of Ethics Council in implementing sanctions against ASN based on DKI Jakarta Gubernatorial Regulation Number 98 of 2021 concerning the Code of Ethics and Code of Conduct for ASN Employees? and What are the obstacles to implementing ASN code of ethics sanctions at the DKI Jakarta Transportation Service. The theory used is the theory of authority and law enforcement. The method used is empirical juridical with data analysis through a qualitative approach using primary data in the form of interviews and secondary data in the form of library research. The research results show that the Inspectorate as the ASN Code of Ethics Council has the authority to carry out the monitoring process until after the violation occurs in the form of receiving reports, tracing, examination, trial, and recommendations for imposing sanctions. The obstacles faced include ASN's lack of awareness of the code of ethics guidelines, employee capacity that is not commensurate with the amount of workload and the effectiveness of the flow of sanctions that is not yet optimal. In conclusion, the Inspectorate as the Code of Ethics Council has not been able to carry out its duties properly due to various obstacles in implementation. Suggestions, the DKI Jakarta provincial inspectorate needs to optimize the handling of supervision until after the incident of code of ethics violations.

Additional Information: | Aparatur Sipil Negara dalam menjalankan tugas pemerintahan memiliki pedoman berperilaku yang disebut pedoman kode etik. Proses pelaksanaan kode etik dilakukan oleh Inspektorat Provinsi DKI Jakarta selaku Majelis Kode Etik yang mengatur mengenai pengawasan dan pembinaan aparatur sipil negara salah satunya pada Dinas Perhubungan Provinsi DKI Jakarta. Tujuan dari penerapan pedoman kode etik adalah untuk menunjukan sikap professionalitas bekerja aparatur sipil negara yang baik dalam etika bernegara, etika berorganisasi dan etika dalam bermasyarakat. Identifikasi masalah, bagaimana kewenangan Majelis Kode Etik dalam penerapan sanksi terhadap ASN berdasarkan Pergub DKI Jakarta Nomor 98 tahun 2021 Tentang Kode Etik dan Kode Perilaku Pegawai ASN? dan Apa kendala penerapan sanksi kode etik ASN pada Dinas Perhubungan DKI Jakarta. Teori yang digunakan adalah teori kewenangan dan penegakan hukum. Metode yang digunakan adalah yuridis empiris dengan analisis data melalui pendekatan kualitatif menggunakan data primer berupa wawancara dan data sekunder berupa penelitian kepustakaan. Hasil penelitian menunjukan bahwa Inspektorat sebagai Majelis Kode Etik ASN memiliki kewenangan melakukan proses pengawasan hingga pasca kejadian pelanggaran berupa penerimaan laporan, penelusuran, pemeriksaan, persidangan, hingga rekomendasi penjatuhan sanksi. Kendala yang dihadapi berupa kurangnya kesadaran ASN akan pedoman kode etik, kapasitas pegawai yang tidak sebanding dengan jumlah beban kerja dan efektivitas alur penjatuhan sanksi yang belum maksimal. Kesimpulan, Inspektorat sebagai Majelis Kode Etik belum bisa melaksanakan tugasnya dengan sesuai disebabkan oleh berbagai kendala dalam pelaksanaan. Saran, Inspektorat provinsi DKI Jakarta perlu melakukan optimalisasi penanganan pengawasan hingga pasca kejadian pelanggaran kode etik. | |||||||||
