Abstract
Land rights cannot be changed in the form of transfer of other rights such as sold, exchanged, guaranteed, under Act No. 41 of 2004. As for the identification of the problem, is the procedure for the implementation of swap of waqf land regulated in the Law No. 41 of 2004 on Waqf? And how are the provisions for the rollover of waqf land under the hands linked to the Law No. 41 of 2004 on waqf? This research is intended to find out the procedure of rollover (ruislag) of waqf land based on the Law No. 41 of 2004 on Waqf and to know how the provisions of rollover (ruislag) of waqf land under hand are linked to the Law no. 41 from 2004 on waqf. The theories used are Law certainty and Maslahah mursalah. The specifications of the research used are descriptive analytics, with a normative jurisprudential approach. The research phase consists of library research and field research. Data analysis used is qualitative analysis. Based on the results of the research, the procedure for the rollover (ruislag) of waqf land under the provisions of the Law No. 41 of 2004 on Waqf may be implemented under the terms of the land of waqf used against the effect of the General Plan of Space Administration. The procedure for rollover waqf (ruislag), waqf ground under the hands according to the stipulations of the Act No. 41, 2004 on waqf is carried out with the public officials or officials who make acts of ikrar waqf. The recommendation is that there should be provisions that make the process of changing the status of the Waqf land faster and easier, and that a policy be made that regulates the management and security of structured Waqf assets.

Dan bagaimana ketentuan tukar guling tanah (ruislag) wakaf dibawah tangan dihubungkan dengan Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf? Penelitian ini dimaksudkan untuk mengetahui prosedur tukar guling (ruislag) tanah wakaf berdasarkan Undang – Undang Nomor 41 Tahun 2004 Tentang Wakaf dan untuk mengetahui bagaimana ketentuan tukar guling (ruislag) tanah wakaf dibawah tangan dihubungkan dengan Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf. Teori yang digunakan ialah Kepastian Hukum dan Maslahah mursalah. Spesifikasi penelitian yang digunakan adalah deskriptif analitis, dengan pendekatan secara yuridis normatif.. Sumber data di dapat melalui studi dokumen dan wawancara. Tahap penelitian terdiri atas penelitian kepustakaan dan penelitian lapangan. Analisis data yang digunakan adalah analisis kualitatif. Berdasarkan hasil penelitian, Prosedur tukar guling (ruislag) tanah wakaf berdasarkan Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf dapat dilaksanakan dengan ketentuan tanah wakaf yang digunakan terdampak Rencana Umum Tata Ruang. Prosedur atas tukar guling (ruislag) tanah wakaf dibawah tangan sesuai dengan ketentuan Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf yaitu dilaksanakan dengan pejabat publik atau pejabat pembuat akta ikrar wakaf. Kesimpulan prosedur pelaksanaan tukar guling tanah wakaf dapat dilaksanakan mengikuti ketentuan dan tukar guling tanah wakaf dibawah tangan dilaksanakan dengan ketentuan dan tata cara yang diatur dalam peraturan perundang-undangan. Saran, perlu adanya ketentuan yang membuat proses perubahan status tanah wakaf dapat berjalan lebih cepat dan mudah, dan dibuatnya kebijakan yang mengatur terkait pengelolaan serta pengamanan aset wakaf yang terstruktur. | |||||||||
