Abstract

Occurrences of procedural errors by radiographers resulting in a patient's death at the radiology installation of Hospital XYZ during a urethrogram examination discussed in the legal protection for radiographers in the implementation of radiological medical procedures related to the Minister of Health Regulation Number 24 of 2020 concerning Clinic Radiology Services. This is of interest because every radiology installation in a hospital has 1-4 radiology specialist doctors who are always present and responsible for clinic radiology services. This research aims to understand the legal protection for radiographers conducting radiological medical procedures and to investigate the implementation of legal protection for radiographers, including the challenges and solutions, in the area of Serang City. The research method used is qualitative with a type of empirical normative legal research through a case study and legal sociology approach. Results of the research indicate that radiographers who carry out radiology medical procedures are legally protected as they receive delegated authority in the form of a mandate from radiology specialists as the responsible party for clinical radiology services listed in the Ministry of Health Regulation Number 24 of 2020 on clinical radiology services. Results of the questionnaire revealed that 100% of radiographers are aware of the need for legal protection, and 90% of them are aware of the prohibition of carrying out radiological medical procedures. However, these actions are still carried out because radiology specialists feel burdened by many tasks and have entrusted them to trained radiographers. The proposed solution requires the assistance of other healthcare workers, including nurses. This is in line with one of the healthcare workers allowed to receive the delegation of medical actions, as stated in Article 286 paragraph (3) point b of Law Number 17 of 2023 concerning health.

Additional Information: Terjadinya kesalahan prosedur oleh radiografer yang mengakibatkan pasien meninggal di instalasi radiologi rumah sakit XYZ pada saat pemeriksaan uretrografi yang dibahas dalam perlindungan hukum terhadap radiografer dalam pelaksanaan tindakan medis radiologi dihubungan dengan Peraturan Menteri Kesehatan Nomor 24 Tahun 2020 tentang Pelayanan Radiologi Klinik. Hal ini menarik perhatian karena setiap instalasi radiologi rumah sakit memiliki dokter spesialis radiologi sebanyak 1-4 orang yang selalu hadir dan bertanggung jawab atas pelayanan radiologi klinik. Penelitian ini bertujun mengetahui tentang perlindungan hukum terhadap radiografer yang melakukan tindakan medis radiologi serta mengetahui pelaksanaan perlindungan hukum terhadap radiografer beserta kendala dan solusinya di wilayah Kota Serang. Metode penelitian yang digunakan adalah kualitatif dengan tipe penelitian hukum normatif empiris melalui pendekatan studi kasus dan sosiologi hukum. Hasil penelitian didapatkan bahwa radiografer yang melaksanakan tindakan medis radiologi mendapatkan perlindungan hukum karena mendapatkan pelimpahan wewenang yang berbentuk mandate dari dokter spesialis radiologi sebagai penanggung jawab pelayanan radiologi klinik yang tercantum dalam Permenkes Nomor 24 tahun 2020 tentang pelayanan radiologi klinik. Hasil quisioner, terungkap bahwa 100% radiografer menyadari perlunya perlindungan hukum, dan 90% di antaranya mengetahui larangan melaksanakan tindakan medis radiologi. Namun tindakan tersebut tetap dilakukan karena dokter spesialis radiologi merasa terbebani oleh banyak tugas dan telah mempercayakan kepada radiografer yang terlatih. Solusi yang diusulkan adalah memerlukan bantuan tenaga kesehatan lain diantaranya perawat. Hal ini sesuai dengan salah satu tenaga kesehatan yang diizinkan menerima pelimpahan wewenang tindakan kedokteran, sebagaimana tercantum dalam Pasal 286 ayat (3) point b Undang-Undang Nomor 17 Tahun 2023 tentang kesehatan.
