Abstract
The Covid-19 Virus Pandemic has had many impacts on society, including companies that have caused bankruptcy or bankruptcy, this has caused the economy in Indonesia to experience a crisis. This economic crisis resulted in delays in business activities so that debtors’ debts could not be paid on time. Financial Services Authority POJK Number 11/POJK.03/2020 concerning National Economic Stimulus as a Countercyclical Policy on the Impact of the Spread of Coronavirus Disease 2019. Therefore the author is interested in researching the considerations the judge’s decision in the case of decision No. 19/Pdt. SusCancellation of Peace/2020/ PN. Commerce. Jkt. Pst is connected with Law Number 37 of 2004 concerning Bankruptcy and Suspension of Obligations for Payment of Debt Juncto Financial Services Authority Regulation Number 11/POJK.03/2020 concerning National Economic Stimulus as a Countercyclical Policy Impact of the Spread of Coronavirus Disease 2019 and the legal consequences of the judge’s decision regarding the cancellation of homologation postponement of debt payments.The theory used in this study is the Theory of Legal Certainty and The Theory of Justice. The research method used is Normative Juridical. The specification of the research used is the Descriptive Analytical approach which describes the applicable laws and regulations associated with legal theories and the practice of implementing positive law. The data source used is secondary data. Data collection techniques in this study, namely secondary data and primary data were collected by conducting library research or better known as library research. Data analysis used is qualitative data analysis. The results of this study stated that the consideration of the Panel of Judges in the trial did not take into account POJK Number 11/POJK/.03 2020 concerning National Economic Stimulus as a Countercyclical Policy on the Impact of the Spread of Coronavirus Disease 2019 and stated that the Debtor/Respondent had been negligent. The panel of judges is expected to consider the Financial Services Authority Regulation Number 11/POJK.03/2020 concerning National Economic Stimulus as a Countercyclical Policy on the Impact of the Spread of Coronavirus Disease 2019 in considering a decision, because there are necessary rules and guidelines, especially in responding to the Covid-19 Pandemic.

| Additional Information: | Pandemi Virus Covid-19 telah berdampak banyak bagi masyarakat termasuk pada perusahaan yang menyebabkan kebangkrutan ataupun gulung tikar hal ini membuat perekonomian di Indonesia mengalami krisis. Krisis ekonomi ini mengakibatkan terhambatnya gerak bisnis usaha sehingga utang-utang Debitor tidak bisa dibayarkan tepat waktu. Otoritas Jasa Keuangan POJK Nomor 11/POJK.03/2020 tentang Stimulus Perekonomian Nasional Sebagai Kebijakan Counteryclical Dampak Penyebaran Coronavirus Disease 2019. Identifikasi masalah dalam penelitian ini adalah bagaimana pertimbangan putusan hakim dalam perkara putusan Nomor 19/Pdt. Sus-Pembatalan Perdamaian/2020/ PN. Niaga. Jkt. Pst dihubungkan dengan Undang-undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang Juncto Peraturan Otoritas Jasa Keuangan Nomor 11/POJK.03/2020 tentang Stimulus Perekonomian Nasional Sebagai Kebijakan Counteryclical Dampak Penyebaran Coronavirus Disease 2019 dan bagaimana akibat hukum putusan hakim tentang pembatalan homologasi penundaan pembayaran utang. Teori yang digunakan dalam penelitian ini yaitu Teori Kepastian hukum dan Teori Keadilan. Metode penelitian yang digunakan yaitu Yuridis Normatif. Spesifikasi penelitian yang digunakan yaitu pendekatan Deskriptif Analitis yang mendeskripsikan peraturan perundang-undangan yang berlaku dikaitkan dengan teori-teori hukum dan praktek pelaksanaan hukum positif. Sumber data yang digunakan yaitu data sekunder. Teknik pengumpulan data dalam penelitian ini yaitu data sekunder dan data primer dikumpulkan dengan melakukan penelitian kepustakaan atau yang lebih dikenal dengan studi kepustakaan (library research). Analisis data yang digunakan yaitu analisis data kualitatif. Hasil penelitian ini menyatakan bahwa Pertimbangan Majelis Hakim dalam persidangan tidak mempertimbangkan terkait dengan POJK Nomor 11/POJK/.03 2020 tentang Stimulus Perekonomian Nasional sebagai Kebijakan Counteryclcal Dampak Penyebaran Coronavirus Diisease 2019 dan menyatakan bahwa Debitor / Termohon telah lalai. Adapun Saran Majelis hakim diharapkan mempertimbangkan Peraturan Otoritas Jasa Keuangan Nomor 11/POJK.03/2020 tentang Stimulus Perekonomian Nasional Sebagai Kebijakan Counteryclical Dampak Penyebaran Coronavirus Disease 2019 dalam mempertimbangkan putusan, karena perlu adanya aturan dan pedoman khususnya dalam merespon Pandemi Covid-19. | |||||||||
