Abstract

Enforcement of civil servant discipline is one of the regulations regarding civil servant discipline which is regulated in Government Regulation Number 94 of 2021 concerning Civil Servant Discipline. Regulations regarding this discipline extend to the extent of the legal implications for guidance given to civil servants who violate working hours regulations in Serang City Government. The first identification of the problem is, namely, what are the legal implications in enforcing civil servant discipline regarding violations of working hours in the Serang City Government based on Government Regulation Number 94 of 2021 concerning Civil Servant Discipline? Then the second is what are the obstacles to implementing civil servant discipline? Violations of working hours in Serang City Government based on Government Regulation Number 94 of 2021 concerning Civil Servant Discipline? The theories used are Law Enforcement Theory and Government Action Theory. The research method is empirical juridical. The research specification is descriptive analysis. The data source is primary data supported by secondary data. Data collection techniques are field studies and literature studies related to research. Data was obtained and analyzed descriptively using a qualitative approach method. The results of research regarding legal implications in enforcing civil servant discipline regarding violations of working hours in the Serang City Government, based on data obtained from the Serang City Personnel and Human Resources Development Agency, there are 7 civil servants who violated working hours regulations in the presence of state civil servants Those who violate the working hours disciplinary rules are given guidance but this does not show that the employee's performance is getting better, but in the opposite direction, civil servants who violate the working hours rules greatly affect the productivity of the agency where the state civil servants work and are subject to heavy sanctions. In enforcing civil servant discipline, of course there are obstacles and need to be optimized, because there are still civil servants who violate working hours discipline. The conclusion is that the Serang City Government has implemented civil servant discipline enforcement as per Government Regulation Number 94 of 2021 concerning Civil Servant Discipline delegated to Governor Regulation Number 52 of 2021 concerning Procedures for Enforcing Discipline of State Civil Servants within the Banten Provincial Government and Serang Mayor Regulation Number 88 of 2021 concerning Technical Guidelines for Enforcement of Civil Servants within the Serang City Government. Suggestions: If there are civil servants who are indicated to have committed a disciplinary violation, they should immediately carry out an examination and guidance by their superiors, but if there are no changes, report them to the authorized official, namely the Personnel and Human Resources Development Agency.

Adapun identifikasi masalah yang pertama yaitu Bagaimana Implikasi Hukum Dalam Penegakan Hukum Disiplin Pegawai Negeri Sipil Terhadap Pelanggaran Jam Kerja di Pemerintah Kota Serang Berdasarkan Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai NegeriSipil ?,Kemudian yang kedua ialah Bagaimana hambatan pelaksanaan disiplin pegawai negeri sipil terhadap pelanggaran jam kerja di pemerintah kota serang berdasarkan Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil ?,Teori yang digunakan ialah Teori Penegakan Hukum dan Teori Tindakan Pemerintah. Metode penelitian yaitu yuridis empiris. Spesifikasi penelitian yaitu deskriptif analisis. Sumber data yaitu data primer yang ditunjang oleh data sekunder. Teknik pengumpulan data adalah studi lapangan dan studi kepustakaan yang terkait dengan penelitian. Data diperoleh dan analisis secara deskriptif dengan metode pendekatan kualitatif. Hasil penelitian mengenai Implikasi Hukum Dalam Penegakan Disiplin Pegawai Negeri Sipil Terhadap pelanggaran Jam Kerja Di Pemerintah Kota Serang, berdasarkan data yang didapatkan dari Badan Kepegawaian dan Pengembangan Sumber Daya Manusia Kota Serang terdapat 7 orang pegawai negeri sipil yang melanggar aturan jam kerja dengan adanya aparatur sipil negara yang melanggar aturan disiplin jam kerja tersebut dilakukan pembinaan tetapi tidak menunjukan kinerja pegawai kearah yang semakin baik tetapi kearah sebaliknya pegawai negeri sipil yang melanggar aturan jam kerja sangat mempengaruhi produktivitas instansi dimana aparatur sipil negara tersebut bekerja dan dikenakan sanksi berat. didalam menjalankan penegakan disiplin pegawai negeri sipil tentu ada kendala dan perlu adanya optimalisasikan, sebab masih terdapat pegawai negeri sipil yang melakukan pelanggaran disiplin jam kerja. Kesimpulan yaitu Pemerintah Kota Serang telah menerapkan penegakan disiplin pegawai negeri sipil sebagaimana Peraturan Pemerintah Nomor 94 Tahun 2021 tentang Disiplin Pegawai Negeri Sipil didelegasikan kepada Peraturan Gubernur Nomor 52 Tahun 2021 tentang Tata Cara Penegakan Disiplin Aparatur Sipil Negara Di Lingkungan Pemerintah Provinsi Banten dan Peraturan Wali Kota Serang Nomor 88 Tahun 2021 tentangPedoman Teknis Penegakan Pegawai Negeri Sipil Di Lingkungan Pemerintah Kota Serang. Saran apabila ada pegawai negeri sipil yang diindikasi melakukan pelanggaran disiplin maka segera dilakukan pemeriksaan dan pembinaan oleh atasan tetapi jika tidak ada perubahan melapor kepada pejabat yang berwenang yaitu Badan Kepegawaian Dan Pengembangan Sumber Daya Manusia
