Abstract
Supervision of electronic system providers is carried out to prevent the dissemination of misuse of electronic systems that violate laws and regulations through blocking. One of these abuses is online gambling sites where from 2020 to 2023 the level of blocking of online gambling sites continues to increase, the supervision of online gambling sites is the authority of the Ministry of Communication and Information of the Republic of Indonesia. The problem identification in this study is the authority of the Ministry of Communication and Information in supervising online gambling sites based on the regulation of the Minister of Communication and Information Number 5 of 2020 about the implementation of private electronic system and the obstacles of the Ministry of Communication and Information as a supervisor of electronic systems containing online gambling. The theory used is the theory of authority and the theory of supervision. The method used is empirical juridical, with specifications in the form of descriptive analysis. The data source is secondary data, with the data collection technique of library studies and field studies and the data analysis used is descriptive qualitative and the research location used is the Ministry of Communication and Information and the Sultan Ageng Tirtayasa University Library. The conclusion of this research is that the authority possessed by the Ministry of Communication and Information is clearly in accordance with the rules which have authority by attribution, delegation and mandate. In addition, the supervision owned by Kominfo has 3 (three) scopes of supervision in the Regulation of the Minister of Communication and Information Technology Number 5 of 2020 concerning Private Scope PSE where the supervision is regarding PSE registration, supervision through granting access to electronic systems and ownership of audit track records that must be owned by PSE and has obstacles to supervision of online gambling sites including continuous repeated appearances, offering online gambling sites through advertisements on social media and personal messages, law enforcement related to gambling activities is regulated differently in each country. The suggestion from this research is the need for authority to be established between international countries for international supervision.

| Additional Information: | Pengawasan terhadap penyelenggara sistem elektronik dilakukan guna mencegah penyebarluasan penyalahgunaan sistem elektronik yang melanggar peraturan perundang-undangan melalui pemblokiran. Salah satu penyalahgunaan tersebut adalah situs judi online yang dimana dari tahun 2020 sampai dengan 2023 tingkatan pemblokiran terhadap situs judi online terus meningkat, pengasawan terhadap situs judi online ini merupakan kewenangan daripada Kementerian Komunikasi dan Informatika Republik Indonesia. Identifikasi masalah dalam penelitian ini yaitu bagaimana kewenangan Kementerian Kominfo dalam pengawasan terhadap situs judi online berdasarkan peraturan Menteri Kominfo Nomor 5 Tahun 2020 tentang Penyelenggaran Sistem Elektronik Lingkup Privat dan bagaimana hambatan Kominfo sebagai pengawas terhadap sistem elektronik yang bermuatan perjudian online. Teori yang digunakan teori kewenangan dan teori pengawasan. Metode yang dipakai yaitu yang dipakai yaitu yuridis empiris, dengan spesifikasi berupa deskriptis analisis. Sumber datanya yaitu data sekunder, dengan Teknik pengumpulan data studi kepustakan dan studi lapangan serta analisis data yang digunakan yaitu deskriptif kualitatif serta lokasi penelitian yang digunakan adalah Kementerian Komunikasi dan Informatika dan Perpustakaan Universitas Sultan Ageng Tirtayasa. Kesimpulan dari penelitian ini yaitu kewenangan yang dimiliki oleh Kementerian Kominfo jelas telah sesuai aturan dimana memiliki kewenangan secara atribusi, delegasi dan mandat. Selain itu, pengawasan yang dimiliki kominfo memiliki 3 (tiga) lingkup pengawasan yang ada pada Peraturan Menteri Komunikasi dan Informatika Nomor 5 Tahun 2020 Tentang PSE Lingkup Privat dimana pengawasan tersebut mengenai yakni pendaftaran PSE, pengawasan melalui pemberian akses sistem elektronik dan kepemilikan rekam jejak audit yang harus dimiliki oleh PSE serta memiliki hambatan pengawasan terhadap situs judi online antaralain kemunculan yang berulang terus menerus, penawaran situs judi online melalui iklan di media sosial dan pesan personal, penegakan hukum terkait kegiatan perjudian diatur secara berbeda di tiap negara. Saran dari penelitian ini yaitu perlunya kewenangan yang dijalin antara internasional guna pengawasan internasional. | |||||||||
