Abstract
Jalan Aat-Rusli (JAR) Cilegon is a connecting route to strategic areas but there is a lot of damage that affects the safety of road users. Law Number 38 of 2004 concerning Roads (Road Law) provides instructions to road operators to coordinate with the LLAJ Agency in supervising and controlling vehicle loads as road damaging factors. The identification of this research problem is how the authority of the Cilegon City Government (Pemkot) in supervising roads on the JAR section to create road user safety based on the Road Law? and What are the obstacles in the supervision of the JAR section by the Cilegon City Government in creating road user safety based on the Road Law? The theory used is authority, and supervision. The methods used are empirical juridical, analytical descriptive type, primary and secondary data sources, field research and literature data collection techniques, qualitative date analysis. The results of the study were that the Cilegon DPUPR coordinated with the Cilegon Dishub and Cilegon Police verbally regarding the supervision and control of vehicle loads in the JAR and obtained information on the limits of authority of the Cilegon City Dishub, and the findings of parking levies when the Police conducted surveillance at the JAR. DPUPR Cilegon carries out routine and periodic maintenance of JAR damage and submission of repairs to the Ministry of PUPR based on the limitations of the APBD and the strategic of JAR. The role of Dishub Cilegon is to carry out active, preventive, and repressive supervision through parking patrols, LLAJ safety socialization, audit vehicle inspections and propose weighing activities to BPTD Banten, and coordinate with the Cilegon Regional Police, the obstacles are not having weighing authority, limited number of PPNS, and inadequate activity budget, in conclusion DPUPR Cilegon is authorized to organize JAR delegatively and has acted in accordance with its obligations and authorities, but is constrained by the APBD which does not accommodate improvements and legal awareness of road users and companies, Dishub Cilegon as the organizer of transportation affairs of the Cilegon City Government has carried out active, preventive, and repressive supervision, but it is hampered due to the absence of weighing authority, limited number of PPNS, and inadequate activity budget. Suggestions for optimizing the regional budget, improving road status, adding PPNS, intensifying supervision activities with the Banten Police & BPTD.

Undang-Undang Nomor 38 Tahun 2004 tentang Jalan (UU Jalan) memberikan instruksi kepada penyelenggara jalan untuk melakukan koordinasi dengan Instansi LLAJ dalam melakukan pengawasan dan pengendalian muatan kendaraan sebagai faktor perusak jalan. identifikasi masalah penelitian ini yaitu bagaimana kewenangan Pemerintah Kota (Pemkot) Cilegon dalam pengawasan jalan pada ruas JAR untuk menciptakan keselamatan pengguna jalan berdasarkan UU Jalan? dan Apa saja hambatan dalam pengawasan ruas JAR oleh Pemkot Cilegon dalam menciptakan keselamatan pengguna jalan berdasarkan UU Jalan?. teori yang digunakan ialah kewenangan, dan pengawasan. Metode yang digunakan ialah yuridis empiris, berjenis deskriptif analitis, sumber data primer dan sekunder, teknik pengumpulan data penelitian lapangan dan kepustakaan, analisis data secara kualitatif. Hasil penelitian yaitu DPUPR Cilegon berkoordinasi dengan Dishub Cilegon dan Polres Cilegon secara lisan mengenai pengawasan dan pengendalian muatan kendaraan di JAR dan mendapatkan informasi adanya batas kewenangan Dishub Kota Cilegon, dan temuan retribusi parkir saat Kepolisian melakukan pengawasan di JAR. DPUPR Cilegon melakukan pemeliharaan rutin dan berkala terhadap kerusakan JAR serta pengajuan perbaikan ke Kementerian PUPR dengan dasar keterbatasan APBD dan strategisitas JAR. Peran Dishub Cilegon yakni melakukan pengawasan aktif, preventif, dan represif melalui patroli parkir, sosialisasi keselamatan LLAJ, audit inspeksi kendaraan serta mengusulkan kegiatan penimbangan ke BPTD Banten, dan berkoordinasi dengan Polres Cilegon, hambatannya yakni tidak memiliki kewenangan penimbangan, jumlah PPNS yang terbatas, dan anggaran kegiatan tidak memadai, kesimpulannya DPUPR Cilegon berwenang atas penyelenggaraan JAR secara delegatif dan telah bertindak sesuai dengan kewajiban serta kewenangannya, tetapi terkendala APBD yang tidak mengakomodir perbaikan serta kesadaran hukum pengguna jalan dan perusahaan, Dishub Cilegon selaku penyelenggara urusan perhubungan Pemkot Cilegon telah melakukan pengawasan aktif, preventif, dan represif, tapi terhambat karena ketiadaan kewenangan penimbangan, jumlah PPNS terbatas, & anggaran kegiatan tidak memadai. Saran optimalisasi APBD, peningkatan status jalan, penambahan PPNS, mengintensifkan kegiatan pengawasan bersama Kepolisian & BPTD Banten. | |||||||||
