Abstract
A criminal act of passing on or buying stolen goods is a crime committed by a person by buying something that turns out to be the result of a crime such as theft, embezzlement, fraud, extortion and spoils, which is called "conspiracy" or commonly called "cistern" it is actually just an act that as classified in Article 480 paragraph (1) of the Criminal Code up to Article 482 of the Criminal Code. So the researchers identified the problem, namely the first, what are the judges' considerations in imposing sanctions on the criminal act of fencing motorcycles (Study of Decision Number 1033/Pid.B/2021/PN Srg)? Second, how is law enforcement in the application of the crime of fencing motorcycles (Study of Decision Number 1033/Pid.B/2021/PN Srg)?. In this study, researchers used two theories, namely the first theory of judges' consideration ratio decidendi and the second theory of law enforcement. Furthermore, researchers used research methods with qualitative research methods with a library approach, then researchers used normative juridical legal research using field studies, besides that researchers used interview methods to strengthen data evidence in this scription, while the legal materials or sources used were legal materials. primary, secondary legal materials and tertiary legal materials, in data collection techniques researchers used library research and also literature studies, so in this study also used analytical descriptive research. The result of this study is that the panel of judges is expected to provide more severe sanctions for perpetrators of criminal acts of motorcycle fencing accompanied by forgery letters of motorcycles in accordance with the legal considerations of the judge ratio decidendi, the Public Prosecutor should be able to understand which articles are appropriate to use in the indictment, then the prosecutor should change his indictment letter from an alternative indictment to a cumulative indictment and for the society to be able to open their views and conscience so that they tend to comply more with the applicable law rules regulations.

| Additional Information: | Tindak pidana penadahan merupakan suatu kejahatan yang dilakukan oleh seseorang dengan cara membeli sesuatu barang yang ternyata merupakan hasil kejahatan seperti pencurian, penggelapan, penipuan, pemerasan dan hasil rampasan, yang dinamakan ―sekongkol‖ atau biasa pula disebut ―tadah‖ itu sebenarnya hanya perbuatan yang sebagaimana di klasifikasikan dalam Pasal 480 ayat (1) KUHP sampai dengan Pasal 482 KUHP. Sehingga peneliti mengidentifikasi masalah yaitu yang pertama, bagaimana pertimbangan hakim dalam pemberian sanksi terhadap tindak pidana penadahan sepeda motor (Studi Putusan Nomor 1033/Pid.B/2021/PN Srg)? Kedua, bagaimana penegakan hukum dalam penerapan tindak pidana penadahan sepeda motor (Studi Putusan Nomor 1033/Pid.B/2021/PN Srg)?. Dalam penelitian ini peneliti menggunakan dua teori yaitu pertama teori pertimbangan hakim ratio decidendi dan kedua teori penegakan hukum. Selanjutnya peneliti menggunakan metode penelitian dengan metode penelitian kualitatif dengan pendekatan kepustakaan, kemudian peneliti menggunakan jenis penelitian hukum yuridis normatif dengan menggunakan studi lapangan, selain itu peneliti menggunakan cara wawancara sebagai penguatan bukti data dalam skripsi, adapun bahan atau sumber hukum yang digunakan adalah melalui bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier, dalam teknik pengumpulan data peneliti menggunakan studi kepustakaan dan juga studi literatur, maka dalam penelitian ini juga menggunakan penelitian deskriptif analitis. Adapun hasil dari penelitian ini adalah Majelis hakim diharapkan dapat memberikan sanksi yang lebih berat bagi pelaku tindak pidana penadahan sepeda motor yang disertai dengan pemalsuan surat kendaraan bermotor sesuai dengan pertimbangan hukum hakim ratio decidendi, Jaksa Penuntut Umum sebaiknya agar dapat memahami mengenai Pasal-pasal mana yang tepat untuk digunakan dalam surat dakwaan, kemudian seharusnya jaksa mengganti surat dakwaannya dari dakwaan alternatif ke dakwaan kumulatif dan untuk masyarakat agar dapat membuka pandangannya dan hati nuraninya untuk cenderung lebih menaati aturan hukum yang berlaku. | |||||||||
