Abstract
The recruitment of children in armed conflict is one of the major issues facing international humanitarian law. Myanmar is the only foreign country to appear on nearly every list of countries recruiting child soldiers globally. The UNICEF report shows that around 300 thousand children under the age of 18 have been recruited and exploited as child soldiers. In 2002, according to the report, Myanmar had 70,000 child soldiers under the age of 18. Identification of the problem in this study is regarding the legal consequences of Myanmar's deprivation of children's rights through recruiting children into the army in the view of the United Nation Convention on the Right of the Child (UNCRC) and Myanmar's responsibility for the deprivation of the rights of children who become child prisoners in the view of the United Nation Convention. on the Right of the Child (UNCRC). The theory that researchers use is the theory of legal protection and state responsibility. This writing research uses the Normative Juridical method using normative legal research data types which are divided into primary legal materials, secondary materials, and tertiary legal materials. The analysis of this writing research uses qualitative descriptive and in collecting research data this writing is obtained through library research and accessing data through journals, as well as the internet. The legal consequences for Myanmar's actions of depriving children's rights through recruiting children into the army are reviewed by the United Nation Convention on the Right of the Child (UNCRC), it is hoped that there will be punishments that will provide a deterrent effect for Myanmar. The conclusions in this study are. Myanmar's responsibility for the deprivation of the rights of children who become child internees reviewed by the United Nations Convention on the Right of the Child (UNCRC) is difficult to prove and even though the 1949 Geneva Convention has not regulated more specific provisions for child soldiers. Suggestions in this research should be Myanmar as a country that has agreed to implement these rules and not commit violations of these rules which result in children becoming victims of war because they are recruited into the army

Additional Information: | Perekrutan anak dalam konflik bersenjata merupakan salah satu isu besar yang dihadapi hukum humaniter internasional. Myanmar adalah satu satunya negara Asing yang muncul di hampir setiap daftar negara yang merekrut tentara anak secara global. Laporan UNICEF menunjukan ada sekitar 300 ribu anak dibawah umur 18 tahun telah direkrut dan dieksploitasi sebagai tentara anak (child soldiers) Pada tahun 2002, Menurut laporan itu, Myanmar punya 70.000 tentara anak di bawah usia 18 tahun. Identifikasi masalah dalam penelitian ini yaitu mengeni akibat hukum terhadap tindakan Myanmar yang melakukan perampasan hak anak melalui perekrutan anak menjadi tentara ditinjau United Nation Convention on the Rright of the Child (UNCRC) dan pertanggungjawaban Myanmar terhadap perampasan hak anak yang menjadi terntara anak ditinjau United Nation Convention on the Rright of the Child (UNCRC). Teori yang peneliti gunakan yaitu teori perlindungan hukum dan tanggung jawab negara. Penelitian penulisan ini menggunakan metode Yuridis Normatif dengan menggunakan jenis data penelitian hukum normative yang terbagi menjadi bahan hukum promer, bahan sekunder, serta bahan hukum tersier. Analisis penelitian penulisan ini menggunakan Deskriptif Kualitatif dan dalam mengumpulkan data penelitian penulisan ini didapatkan melalui studi kepustakaan dan pengaksesan data melalui Jurnal, maupun internet. Akibat hukum terhadap tindakan Myanmar yang melakukan perampasan hak anak melalui perekrutan anak menjadi tentara ditinjau United Nation Convention on the Rright of the Child (UNCRC), diharapkan akan ada hukuman yang memberikan efek jera bagi Myanmar Kesimpulan dalam penelitian ini adalah. pertanggung jawaban Myanmar terhadap perampasan hak anak yang menjadi terntara anak ditinjau United Nation Convention on the Rright of the Child (UNCRC) sulit untuk dibuktikan dan juga meskipun Konvensi Jenewa 1949 belum mengatur tentang pengaturan yang lebih spesifik untuk para tentara anak. Saran dalam penelitian inu seharusnya Myanmar sebagai Negara yang telah menyepakati aturan tersebut menjalankannya dan tidak melakukan pelanggaran terhadap aturan tersebut yang mengakibatkan anak-anak menjadi korban peperangan karena direkrut menjadi tentara. | |||||||||
