Abstract
Copyright is important in the development of intellectual works and is regulated in Law Number 28 of 2014 concerning Copyright. One of the copyright cases in Decision Number 35/Pdt.Sus-Hak Cipta/2020/PN Niaga Jkt.Pst. is a claim for damages brought against Grand Indonesia Mall for using the sketch image "Tugu Selamat Datang” as its corporate logo. The issue is identified, specifically how to protect copyright for PT. Grand Indonesia's use of the "Tugu Selamat Datang” sketch based on Law Number 28 of 2014 Concerning Copyright and how the legal factors taken into account by the panel of judges in Decision Number 35/Pdt.Sus-Hak Cipta/2020/PN Niaga Jkt.Pst relate to Law Number 28 of 2014 Concerning Rights Create. The theory used is the theory of legal protection and reward theory. The research method used is normative juridical with analytical descriptive research specifications using a statutory approach. The data source used is secondary data, which was collected utilizing literature studies and then descriptively and qualitatively assessed. The study's findings led to the conclusion that the Selamat Datang Monument sketch is a work of art in the form of an image and is protected by copyright according to Article 40 paragraph (1) letter f UUHC. The "Tugu Selamat Datang” sketch was made on the basis of an idea and under the direction and supervision of President Soekarno, and the creation of the sketch and the statue was also based on President Soekarno's order for the benefit of the 1962 Asian Games and should be known as fully state property. This is why the Panel of Judges' consideration of this issue in Decision Number 35/Pdt.Sus-Copyright/2020/PN Niaga Jkt.Pst is incompatible with Articles 34 and 35 paragraph (1) UUHC. | Additional Information: | Hak cipta menjadi hal penting dalam perkembangan karya-karya intelektul dan diatur di dalam Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Salah satu kasus hak cipta pada Putusan Nomor 35/Pdt.Sus-Hak Cipta/2020/PN Niaga Jkt.Pst. merupakan gugatan ganti rugi karena penggunaan gambar sketsa “Tugu Selamat Datang” sebagai logo perusahaan Mal Grand Indonesia. Identifikasi masalah yaitu bagaimana perlindungan perlindungan hukum terhadap hak cipta atas penggunaan sketsa “Tugu Selamat Datang” oleh PT. Grand Indonesia berdasarkan Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta dan bagaimana pertimbangan hukum dari majelis hakim dalam Putusan Nomor 35/Pdt.Sus-Hak Cipta/2020/PN Niaga Jkt.Pst dihubungkan dengan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Teori yang digunakan yaitu teori perlindungan hukum dan teori reward. Metode penelitian, yuridis normatif dengan spesifikasi penelitian deskriptif analitis yang menggunakan pendekatan Perundang-undangan. Sumber data yang digunakan yaitu data sekunder dengan menggunakan teknik pengumpulan data berupa studi kepustakaan serta dianalisis secara deskriptif kualitatif. Hasil penelitian meyimpulkan bahwa gambar sketsa Tugu Selamat Datang merupakan karya seni rupa berupa gambar dan memiliki perlindungan hukum terhadap hak cipta sebagaimana diatur dalam Pasal 40 ayat (1) huruf f UUHC. Pertimbangan Majelis Hakim dalam Putusan Nomor 35/Pdt.Sus-Hak Cipta/2020/PN Niaga Jkt.Pst terdapat ketidaksesuaian dengan Pasal 34 dan 35 ayat (1) UUHC. karena sketsa Tugu Selamat Datang dibuat berdasarkan ide dan dalam pengawasan dan pimpinan Presiden Sokarno, terciptanya sketsa dan patung tersebut juga atas dasar perintah Presiden Soekarno untuk kepentingan Asian Games tahun 1962 sehingga seharusnya diketahui sebagai milik negara sepenuhnya.
