Abstract
Traditional cultural expression is a way of life for the Indonesian nation, which teaches traditions through art, one of which is Pencak silat Terumbu. This martial arts should be maintained by the state based on article 38 of Law Number 28 of 2014 concerning Copyright. In reality, this martial arts is still a local community that manages and maintains and there is no role for local governments in dealing with these problems. Therefore, the author is interested in researching the legal protection and development of reef martial arts as an expression of traditional culture in the Kasemen District of Serang City. The theories used are legal protection theory and development law theory. The research method used is empirical normative. The research specifications used are the implementation of positive legal provisions (legislation). The data source used is secondary data primary data. The data analysis used is qualitative data analysis. The results of this study state that the legal protection of Reef martial arts as an expression of traditional culture in the Serang City Kasemen District, in this case the Serang City Regional Government has issued Serang City Regional Regulation Number 4 of 2013 concerning Regional Cultural Preservation. The development of traditional cultural expressions of Reef martial arts in the Serang City Kasemen Subdistrict of the Serang City Education and Culture Office in implementing Serang City Regional Regulation Number 4 of 2013 concerning the Preservation of Regional Culture has implemented it but not in its entirety. The suggestion of this research is that in this case the Serang City Regional Government makes regulations related to the implementation of direct development and the Serang City cultural education office implements policies in the form of a local content curriculum for Reef martial arts in schools in Serang City. | Additional Information: | Ekspresi budaya tradisional merupakan cara hidup bangsa Indonesia, yang mengajarkan tradisi melalui kesenian, salah satunya Pencak silat Terumbu. Pencak silat ini semestinya di pelihara oleh negara didasarkan pada pasal 38 UndangUndang Nomor 28 Tahun 2014 tentang Hak Cipta. Pada kenyataannya, pencak silat ini masih masyarakat setempat yang mengelola dan memelihara serta belum adanya peran pemerintah daerah dalam menangani permasalahan tersebut. Oleh karena itu penulis tertarik meneliti mengenai perlindungan hukum dan pengembangan pencak silat terumbu sebagai ekspresi budaya tradisional di Kecamatan Kasemen Kota Serang. Teori yang digunakan yaitu teori perlindungan hukum dan teori hukum pembangunan. Metode penelitian yang digunakan yaitu normatif empiris. Spesifikasi penelitian yang digunakan yaitu Implementasi ketentuan hukum positif (perundang-undangan). Sumber data yang digunakan yaitu data sekunder data primer. Analisis data yang digunakan yaitu analisis data kualitatif. Hasil penelitian ini menyatakan bahwa perlindungan hukum pencak silat Terumbu sebagai ekspresi budaya tradisional di Kecamatan Kasemen Kota Serang dalam hal ini Pemerintah Daerah Kota Serang sudah mengeluarkan Peraturan Daerah Kota Serang Nomor 4 Tahun 2013 tentang Pelestarian Kebudayaan Daerah. Pengembangan ekspresi budaya tradisional pencak silat Terumbu di Kecamatan Kasemen Kota Serang Dinas Pendidikan Dan Kebudayaan Kota Serang dalam melaksanakan Peraturan Daerah Kota Serang Nomor 4 Tahun 2013 Tentang Pelestarian Kebudayaan Daerah sudah melaksanakannya namun belum secara keseluruhan. Saran penelitian ini negara dalam hal ini Pemerintah Daerah Kota Serang membuat regulasi yang berkaitan dengan pelaksanaan pengembangan secara langsung dan Dinas pendidikan kebudayaan Kota Serang menerapkan kebijakan dalam bentuk kurikulum muatan lokal untuk pencak silat Terumbu di sekolah-sekolah yang ada di Kota Serang.
