Abstract

ABSTRACT Implementation of the Provisions for a Specific Time Work Agreement (PKWT) in Law Number 11 of 2020 concerning Job Creation Against the Equality of Workers' Rights (Case Study of PT. Yasunaga Indonesia). Article 27 paragraph (2) of the 1945 Constitution, reads: "Every citizen has the right to work and a life worthy of humanity". To make this happen, Law Number 11 of 2020 concerning Job Creation is enacted. One of the contents regulates the time period and compensation for a certain time work agreement (PKWT). This research aims to understand the application of Law number 11 of 2020 concerning Job Creation to the equal distribution of workers' rights at PT. Yasunaga Indonesia and the implementation of the provisions of the specified time work agreement (PKWT) at PT. Yasunaga Indonesia in accordance with Law number 11 of 2020 Concerning Job Creation. Research conducted in a normative empirical manner is legal research concerning the implementation of normative legal provisions in action in any particular legal event that occurs in society by paying attention to the behavior of members of the community themselves complying or not complying with the rule of law, including legal officials having the authority to enforce or not enforce the law. Primary data taken is the result of field research through interviews analyzed with secondary data through literature studies related to research. The results of the study are: first, the enactment of law number 11 of 2020 has not provided equal distribution of workers' rights including the right to increase competency and the right to guarantee job loss due to the validity of the Collective Labor Agreement of PT. Yasunaga Indonesia and the unclear answers to questions regarding pension premiums and severance pay, secondly, the implementation of the provisions of the specified time work agreement (PKWT) at PT. Yasunaga Indonesia is not in accordance with law number 11 of 2020 including the time period and compensation because the employer does not understand the application of this law and the limited authority of labor inspectors to impose sanctions according to law number 11 of 2020.. Additional Information: Undang-Undang Dasar Tahun 1945 Pasal 27 ayat (2), berbunyi: “Tiap-tiap warga negara berhak atas pekerjaan dan penghidupan yang layak bagi kemanusiaan”. Untuk mewujudkannya, diberlakukan Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Salah satu isinya mengatur jangka waktu dan kompensasi perjanjian kerja waktu tertentu (PKWT). Penelitian ini bertujuan untuk memahami berlakunya Undang-Undang nomor 11 tahun 2020 tentang Cipta Kerja terhadap pemerataan hak pekerja di PT. Yasunaga Indonesia dan pelaksanaan berlakunya ketentuan perjanjian kerja waktu tertentu (PKWT) di PT. Yasunaga Indonesia sesuai dengan Undang-Undang nomor 11 tahun 2020 Tentang Cipta Kerja. Penelitian dilakukan secara normatif empiris adalah penelitian hukum mengenai implementasi ketentuan hukum normatif secara in action pada setiap peristiwa hukum tertentu terjadi dalam masyarakat dengan memperhatikan perilaku dari anggota masyarakat sendiri mematuhi atau tidak mematuhi aturan hukum, termasuk pejabat hukum berwenang menegakkan atau tidak suatu hukum tersebut. Data primer yang diambil merupakan hasil penelitian lapangan melalui wawancara dianalisis dengan data sekunder melalui studi kepustakaan yang berkaitan dalam penelitian. Hasil penelitian bahwa: pertama, Berlakunya undang-undang nomor 11 tahun 2020 belum memberikan pemerataan hak pekerja diantaranya hak meningkatkan kompetensi dan hak jaminan kehilangan pekerjaan dikarenakan masih berlakunya Perjanjian Kerja Bersama PT. Yasunaga Indonesia dan belum jelasnya jawaban pertanyaan perihal iuran premi dan pesangon pensiun, kedua, Pelaksanaan berlakunya ketentuan perjanjian kerja waktu tertentu (PKWT) di PT. Yasunaga Indonesia belum sesuai dengan undang-undang nomor 11 tahun 2020 diantaranya jangka waktu dan kompensasi dikarenakan pengusaha belum memahami atas pemberlakuan undang-undang tersebut dan keterbatasan kewenangan pengawas ketenagakerjaan untuk memberikan sanksi sesuai undang-undang nomor 11 tahun 2020.
