Abstract

The British government took the decision to expel 23 Russian diplomats on March 14, 2018 for being linked as spies and responsible for the neurotoxin attack on former intelligence agent Sergei Skripal and his daughter, Yulia. This study uses two identification problems, namely How the Perspective of Diplomatic Law (Vienna Convention 1691) Against the Actions of the British State Persona Non Grata against the Russian State Diplomatic Officials and How the Diplomatic Law Implementation in the Persona non grata actions by the British State against the Russian State Diplomatic Officials. The researcher uses Representative Theory and Persona Non grata Theory. The research method used in this thesis is the juridicalnormative method with descriptive analysis, using secondary data in the form of legal materials obtained by means of a literature study and then analyzed through a law approach and a case approach. This study aims to determine the mechanism of expulsion of Russian ambassador staff by the British State and whether the expulsion of Russian ambassador staff by the British State is an act that violates the 1961 Vienna Convention on Persona Non Grata. The result of the research is that the British Government wants to protect its citizens and country to avoid Russian espionage which endangers the British nation and state but the Russian Government refuses to provide a statement related to the attempted murder case so that the UK does not find any other alternative which shows that Russia is not involved in the case. The conclusion of this research is that the implication of the Persona non grata action carried out by the British against Russian diplomatic staff from the perspective of diplomatic law is an act that does not conflict with diplomatic law because the British government wants to protect its citizens and country to avoid Russian espionage. Finally, the suggestion from this research is that in order for a country to really be able to carry out its relations with other countries, both bilateral and multilateral relations, it must first understand and respect the constitutional regulations of the destination country.

Penelitian ini menggunakan dua identifikasi masalah yaitu Bagaimana Persfektif Hukum Diplomatik (Konvensi Wina 1691) Terhadap Tindakan Persona Non Grata Negara Inggris terhadap Pejabat Diplomatik Negara Rusia dan Bagaimana Implementasi Hukum Diplomatik dalam tindakan Persona non grata oleh Negara Inggris terhadap Pejabat Diplomatik Negara Rusia. Peneliti menggunakan Teori Representatif dan Teori Persona Non grata. Metode Penelitian yang digunakan dalam skripsi ini adalah metode yuridis-normatif yang bersifat deskriptif analisis, dengan menggunakan data sekunder berupa bahan-bahan hukum diperoleh dengan cara studi kepustakaan kemudian dianalisis melalui pendekatan undang-undang dan pendekatan kasus. Penelitian ini bertujuan untuk mengetahui mekanisme pengusiran staff duta Rusia oleh Negara Inggris serta apakah pengusiran staff duta Rusia oleh Negara inggris merupakan tindakan yang melanggar konvensi Wina 1961 tentang Persona Non Grata. Hasil dari penelitian adalah Pemerintah Inggris ingin melindungi warga dan negaranya untuk menghindar dari spionase Rusia yang membahayakan bangsa dan negara Inggris akan tetapi Pemerintah Rusia menolak untuk memberikan pernyataan terkait dengan kasus percobaan pembunuhan tersebut sehingga Inggris tidak menemukan alternatif lain yang menunjukkan bahwa Rusia tidak terlibat dalam kasus percobaan permbunuhan ini Kesimpulan dari penelitian adalah Implikasi Tindakan Persona non grata dilakukan Inggris terhadap staff diplomatik Rusia dilihat dari Perspektik Hukum Diplomatik merupakan suatu tindakan yang tidak bertentangan dengan Hukum Diplomatik karena Pemerintah Inggris ingin melindungi warga dan negaranya untuk menghindar dari spionase Rusia. Terakhir, Saran dari penelitian ini yaitu suatu negara agar benar- benar bisa melakukan hubungannya dengan negara lain baik hubungan bilateral maupun hubungan multilateral, maka terlebih dahulu harus memahami dan menghormati peraturan konstitusi negara tujuan.
