Abstract
In the first half of 2020, there was an outbreak of the Coronavirus Disease-19 (Covid-19). One of those affected by the Covid-19 pandemic is the employment sector, by carrying out the Unpaid Leave scheme (leaving workers without being paid) or what is known as Leave Outside the Company's Account. This certainly creates a sense of injustice for workers, especially workers at PT Indowanua Intisentosa, the policy of granting leave outside the dependents is not based on consideration between the company and workers and is carried out unilaterally. Identification of the problem in this study is how the legal arrangements regarding leave outside the dependents carried out by PT Indowanua Intisentosa due to the Covid-19 pandemic and how is the legal validity of PT Indowanua Intisentosa decided to take leave outside the company's responsibility unilaterally for workers due to the Covid-19 pandemic. The frame of mind used in writing this research is using legal protection theory. The method used in writing this thesis is empirical juridical with statutory approach, conceptual approach, and case approach. The data sources used are primary data sources supported by secondary data sources. Primary data collection techniques through interviews with workers, employers, the Manpower Office, and secondary data through library research. Then performed qualitative data analysis. Based on the results of this study, the reason for Unpaid Leave or Unpaid Leave carried out by PT Indowanua Intisentosa, namely due to a decrease in income during the Covid-19 pandemic and the company experienced difficulties in providing wages to its workers, so the company made efficiency by implementing the Unpaid Leave scheme. It can be concluded that the implementation of the Company's Unpaid Leave carried out by PT Indowanua Intisentosa said that its workers had deviated from the Labor Law and applicable company regulations. This can be said to be an illegal act. So that the legal protection of workers is still entitled to their benefits based on their current work agreement, in the sense that the company is obliged to pay full wages while the worker is on leave. So the suggestions in this study are expected that if the company is unable to pay the minimum wage, it is necessary to carry out a bipartite dialogue to obtain an agreement between the employer and the worker. Additional Information: | Pada Pertengahan awal Tahun 2020, terjadi peristiwa penyebaran penyakit Coronavirus Disease-19 (Covid-19). Salah satu yang terdampak akibat pandemi Covid-19 ini adalah bidang ketenagakerjaan, dengan melakukan skema Unpaid Leave (mencutikan pekerja tetapi tidak dibayar) atau bisa disebut dengan Cuti Diluar Tanggungan Perusahaan. Hal ini tentu menimbulkan rasa ketidakadilan bagi para pekerja khususnya pekerja di PT Indowanua Intisentosa, kebijakan pemberian cuti diluar tanggungan tersebut tidak didasarkan atas pertimbangan antara perusahaan dengan pekerja dan dilakukan secara sepihak. Identifikasi masalah dalam penelitian ini adalah bagaimana pengaturan hukum tentang cuti diluar tanggungan yang dilakukan oleh PT Indowanua Intisentosa akibat pandemi Covid- 19 serta bagaimana keabsahan hukum PT Indowanua Intisentosa memutuskan cuti diluar tanggungan perusahaan secara sepihak kepada pekerja akibat pandemi Covid-19. Kerangka pemikiran yang digunakan dalam menulis penelitian ini yaitu menggunakan teori perlindungan hukum. Metode yang digunakan dalam penulisan skripsi ini adalah yuridis empiris dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Sumber data yang digunakan yaitu sumber data primer ditunjang sumber data sekunder. Teknik pengumpulan data primer melalui wawancara dengan Pekerja, Pengusaha, Suku Dinas Tenaga Kerja, dan data sekunder melalui studi kepustakaan. Kemudian dilakukan analisis data secara kualitatif. Berdasarkan hasil penelitian ini bahwa alasan Unpaid Leave atau Cuti Diluar Tanggungan yang dilakukan oleh PT Indowanua Intisentosa yaitu karena adanya penurunan pendapatan selama pandemi Covid-19 dan perusahaan mengalami kesulitan untuk memberikan upah terhadap pekerjanya sehingga perusahaan melakukan efisiensi dengan menerapkan skema Unpaid Leave atau Cuti Diluar Tanggungan Perusahaan. Dapat disimpulkan bahwa penerapan Cuti Diluar Tanggungan Perusahaan yang dilakukan oleh PT Indowanua Intisentosa terhadap pekerjanya dikatakan sudah menyimpang dari Undang-Undang Ketenagakerjaan dan peraturan perusahaan yang berlaku. Hal tersebut dapat dikatakan sebagai perbuatan yang tidak sah. Sehingga perlindungan hukumnya pekerja tetap berhak atas tunjangan mereka berdasarkan perjanjian kerja mereka saat ini, dalam artian perusahaan wajib membayar upah penuh selama pekerja di cutikan. Sehingga saran dalam penelitian ini diharapkan bilamana perusahaan tidak sanggup membayar upah minimum, perlu dilakukan dialog secara bipartit untuk mendapatkan kesepakatan antara pengusaha dengan pekerja.
