Abstract
Name : LUKMAN SENTOSA ID Students Number : 7773190035 ABSTRACT AUTHORITY OF BANTEN REGIONAL POLICE IN ERADICATION OF CRIMINAL ACTS OF TERRORISM (CASE STUDY OF DECISION NUMBER 475/PID.SUS/2020/PN.JKT.BRT) Terrorism is a bad threat to every State in the world, destroying the stability of the State, security functions, socio-cultural, economic, political and can even shake various religious parties, as a legal State, Indonesia has an obligation to protect the rights of its citizens. The stabbing incident on Thursday, October 10, 2019 in Menes Square, Pandeglang Regency by one of the people against Wiranto (Menkopolhukam), which occurred there, was the largest incident that was widely discussed in all information media because it occurred in Pandeglang Regency, which should be known as a thousand kyai and a million students. The arrest of suspected terrorists by Densus 88 Anti-Terror, in the legal area of the Banten Regional Police, occurred. For the purpose of establishing security, peace, and social welfare for the community, terrorists must be eliminated from society at large in accordance with Law Number 5 of 2018 Concerning the Eradication of Criminal Acts of Terrorism and Law Number 2 of 2002 Concerning the Police. As a result, the police have the authority to establish Special Detachment 88 Anti-Terror as a specialized elite force to deal with terrorist acts and their eradication. How is the verdict of the outcomes in the application of terrorist crimes with Wiranto victims? is the issue that this thesis discusses. What power does the regional police level have to look into terrorism-related crimes?. The method used from this thesis is a type of empirical research, the data sources used in this thesis are Primary Data and Skunder Data and tertiary legal materials. Case studies, library resources, and, if necessary, interviews are used in data collecting approaches. the approach that was taken utilizing normative legal reasoning. The conclusion in this thesis is that the authority of the Police in the eradication of criminal acts of terrorism refers to the various efforts taken, the application of legal regulations and sanctions against terror perpetrators, as well as implementing penal and non-penal policies. The ability of the police to provide community safety, protection, and law enforcement includes Special Detachment 88 Anti-function Terror's as the forerunner of repression and arrest. Peristiwa penangkapan para terduga teroris oleh Densus 88 Anti Teror, diwilayah hukum Polda Banten yang terjadi pada pertengahan tahun 2017 merupakan kejadian terbesar yang ramai diperbincangkan disemua media informasi karena terjadi di Kabupaten Pandeglang yang seyogyanya dikenal dengan sebutan seribu kyai dan sejuta santri, kejadian penusukan pada hari Kamis tanggal 10 Oktober 2019 di Alun-alun Menes Kabupaten Pandeglang oleh salah seorang masyarakat terhadap Wiranto (Menkopolhukam RI) yang telah menghadiri acara peresmian Gedung Perkuliahan Baru di Universitas Mathlaul Anwar Banten. Melalui Undang-Undang Nomor 5 Tahun 2018 tentang Pemberantasan Tindak Pidana Terorisme dan Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian, pelaku terorisme wajib diberantas sampai kepada akar-akarnya untuk terciptanya keamanan, ketenteraman dan kesejateraan sosial bagi masyarakat, untuk itu kewenangan kepolisian dalam memberantas tindak pidana terorisme adalah membentuk Detasemen Khusus 88 Anti Teror sebagai pasukan elit khusus untuk menghadapi aksi teroris maupun pemberantasannya. Permasalahan yang dibahas dalam tesis ini adalah Bagaimana putusan hasil dalam penerapan tindak pidana terorisme dengan korban Wiranto? Dan Bagaimana mekanisme kewenangan penyidik tindak pidana terorisme pada kepolisian tingkat daerah?. Metode yang digunakan dari tesis ini yaitu jenis penelitian empiris, sumber data yang digunakan dalam tesis ini yaitu Data Primer dan Data Skunder dan bahan hukum tersier. Teknik pengumpulan data menggunakan studi kasus dan bahan pustaka dan wawancara jika diperlukan. Metode pendekatan yang dilakukan menggunakan yuridis normative. Kesimpulan dalam tesis ini, bahwa kewenangan Kepolisian dalam pemberantasan tindak pidana terorisme mengacu pada berbagai upaya-upaya yang ditempuh, penerapan peraturan-peraturan hukum dan sanksi terhadap pelaku teror, serta menerapkan kebijakan penal dan non penal. Kewenangan Kepolisian untuk mewujudkan perlindungan, pengayoman, dan penegakan hukum bagi masyarakat serta melibatkan peran Detasemen Khusus 88 Anti Teror sebagai bagian terdepan melakukan penindakan dan penangkapan.
